4 During the October 19, 2009, and December 28, 2009 hazardous waste <br /> inspections, disposal records for universal waste were not found on site. <br /> UST violations <br /> HSC 25284(a)(1) Permit to operate. Except as provided in subdivision (c), no person <br /> may own or operate an underground storage tank unless a permit for its operation has <br /> been issued by the local agency to the owner or operator of the tank, or a unified <br /> program facility permit has been issued by the local agency to the owner or operator of <br /> the unified program facility on which the tank is located. <br /> This facility did not have a valid annual permit to operate a UST system in 2009. <br /> This facility did not have a valid annual permit to operate a UST system in 2010. <br /> HSC 25284.2 Annual spill containment testing. The owner or operator of an <br /> underground storage tank with a spill containment structure designed to prevent a <br /> release in the event of a spill or overfill while a hazardous substance is being placed in <br /> the tank shall annually test the spill containment structure to demonstrate that it is <br /> capable of containing the substance until it is detected and cleaned up. <br /> --) Annual spill container testing for the truck stop side was performed on October <br /> 30, 2008, five months late. <br /> 4 Annual spill container testing for the automobile side was performed on <br /> December 22, 2008, seven months late. <br /> HSC 25290.1(c)(1) Primary containment not liquid or vapor tight. Primary <br /> containment shall be constructed, operated, and maintained product tight and <br /> compatible with the stored product. <br /> 4 During the October 30, 2008, UST inspection, 25 gallons of fuel was found in <br /> UDC sump 16A/1 7B and 5 gallons of fuel in UDC sump 14A/15B. <br /> 4 During the December 22, 2008, UST inspection, 25 gallons of fuel was found in <br /> UDC sump 16A/17B. <br /> --) During the October 19, 2009, UST inspection, diesel was found leaking from <br /> piping in dispenser 14A/15B, and approximately one gallon of diesel was found in <br /> the diesel north piping sump at the truck stop side of the facility. <br /> 4 During the December 28, 2009, UST inspection, a visible leak was found in UDC <br /> sump 14A/15B. <br /> 4 During the February 17, 2010, service request permit inspection, diesel was <br /> found in both piping sumps at the truck stop side of the facility. <br /> --) During the October 27, 2010, UST inspection, diesel was found in both piping <br /> sumps and weeping at the unions above the impact valves at all dispensers at the <br /> truck stop side of the facility. <br /> --> During the November 22, 2010, UST inspection, diesel was found in the diesel <br /> piping sump at the automobile side of the facility. <br /> HSC 25290.1(c)(2) Secondary containment not liquid or vapor tight. Secondary <br /> containment shall be constructed, operated, and maintained product tight. The <br /> secondary containment shall also be constructed, operated, and maintained in a manner <br /> to prevent structural weakening as a result of contact with any hazardous substances <br /> released from the primary containment, and also shall be capable of storing the <br /> hazardous substances for the maximum anticipated period of time necessary for the <br /> recovery of any released hazardous substance. <br /> 15 <br />
