• i <br /> (3) Unusual operating conditions observed by the owner or operator including erratic <br /> behavior of product dispensing equipment, the sudden loss of product from the <br /> underground storage tank, or an unexplained presence of water in the tank, <br /> unless system equipment is found to be defective, but has not leaked, and is <br /> immediately repaired or replaced; and <br /> (4) Monitoring results from a release detection method required under Article 3 or <br /> Article 4 that indicate a release may have occurred, unless the monitoring device <br /> is found to be defective, and is immediately repaired, recalibrated or replaced, <br /> and additional monitoring does not confirm the initial results. <br /> (f) The reporting requirements of this article are in addition to any reporting <br /> requirements in section 13271 of Division 7 of the California Water Code and other <br /> laws and regulations. <br /> Releases of fuel found during the October 30, 2008, December 22, 2008, <br /> October 19, 2009, December 21, 2009, and December 28, 2009, UST inspections <br /> were not recorded or reported. <br /> Title 23, CCR 2711(b) and (c) Current Unified Program Consolidated Forms on file <br /> with EHD. <br /> (b) The owner or operator shall inform the local agency of any changes to the <br /> information provided in accordance with subsection (a) within 30 calendar days <br /> unless required to obtain approval before making the change. <br /> (c) The permit applications, "Underground Storage Tank Operating Permit Application - <br /> Facility Information," "Underground Storage Tank Operating Permit Application -Tank <br /> Information," and "Underground Storage Tank Monitoring Plan" in Title 27, Division <br /> 3, Subdivision 1, Chapter 6, shall be accompanied by the local government and state <br /> surcharge fees. <br /> The UPCF facility and tank forms were not current at the time of the December <br /> 22, 2008, UST inspection. <br /> Title 23, CCR 2712(b) Maintenance and monitoring records. Written monitoring and <br /> maintenance records shall be maintained on-site or off-site at a readily available <br /> location, if approved by the local agency, for a period of at least 3 years, 6 1/2 years for <br /> cathodic protection maintenance records, and 5 years for written performance claims <br /> pertaining to release detection systems, and calibration and maintenance records for <br /> such systems. Records of repairs, lining, and upgrades shall be maintained on site or at <br /> another approved location for the remaining life of the underground storage tank. These <br /> records shall be made available, upon request within 36 hours, to the local agency or the <br /> State Water Board. Monitoring records shall include: <br /> (1) The date and time of all monitoring or sampling; <br /> (2) Monitoring equipment calibration and maintenance records; <br /> (3) The results of any visual observations; <br /> (4) The results of all sample analysis performed in the laboratory or in the field, including <br /> laboratory data sheets and analysis used; <br /> (5) The logs of all readings of gauges or other monitoring equipment, ground water <br /> elevations, or other test results; and <br /> (6) The results of inventory readings and reconciliations. <br /> 4 No maintenance and monitoring records were found on site during the June 23, <br /> 2008, October 30, 2008, and December 22, 2008, UST inspections. <br /> 4 During the October 19, 2009, routine UST inspection, four monitoring panel <br /> alarms were found with no supporting documentation showing how the alarms <br /> were corrected. <br /> 19 <br />
