The following is an itemized list of aboveground petroleum storage act violations that <br /> have not been addressed for Gemco Ripon Truck Plaza Inc. as of September 29, <br /> 2021. <br /> Open violations from February 10, 2020 inspection <br /> Violation#715-Failed to provide each container with a high level monitoring device. <br /> The high level monitoring device described in the SPCC plan was stated to not be functional and was not being <br /> used as a high level monitoring device.The SPCC plan describes a direct vision guage for the tanks.The direct <br /> vision gauges on the tanks were described as being non-functional. The SPCC plan does not describe the actual <br /> high level monitoring device being used by the facility. It is stated in the SPCC plan that 55 gallon drums regulated <br /> under APSA are not refilled and therefore do not require a high level monitoring device. It was stated by facility <br /> personnel that the 55 gallon drums are refilled at the facility once they are emptied out. <br /> Engineer or update each container installation in accordance with good engineering practice to avoid discharges. <br /> You must provide at least one of the following devices: <br /> (i) High liquid level alarms with an audible or visual signal at a constantly attended operation or surveillance station. <br /> In smaller facilities an audible air vent may suffice. <br /> (ii)High liquid level pump cutoff devices set to stop flow at a predetermined container content level. <br /> (iii)Direct audible or code signal communication between the container gauger and the pumping station. <br /> (iv)A fast response system for determining the liquid level of each bulk storage container such as digital computers, <br /> telepulse, or direct vision gauges. If you use this alternative, a person must be present to monitor gauges and the <br /> overall filling of bulk storage containers. <br /> (v)You must regularly test liquid level sensing devices to ensure proper operation. <br /> The SPCC plan must address the current high level monitoring device in use by the facility or the SPCC plan must <br /> be implemented as written or an environmental equivalence claim made as allowed by CFR 112.7(a)(2).An <br /> amendment to this section in the SPCC plan will require certification by a Professional Engineer <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#719-Failed to locate properly or provide sufficient secondary containment for mobile/portable <br /> containers. <br /> Mobile or portable oil storage containers did not have a secondary means of containment sufficient to contain the <br /> capacity of the largest single compartment or container with sufficient freeboard to contain precipitation.A 55 gallon <br /> drum of liquid with petroleum product was observed on a secondary containment pallet that did not appear to be <br /> able to contain the 55 gallons of liquid and precipitation.The secondary containment pallet appeared to hold <br /> approximately 25 gallons.A second 55 gallon drum of liquid with petroleum product was observed without <br /> secondary containment as described in the SPCC plan. The second 55 gallon drum was not observed on a <br /> secondary containment pallet,which is the secondary containment required by the SPCC plan. It was not <br /> immediately evident that the second drum had any secondary containment. <br /> Position or locate mobile or portable oil storage containers to prevent a discharge as described in §112.1(b). Except <br /> for mobile refuelers and other non-transportation-related tank trucks,you must furnish a secondary means of <br /> containment, such as a dike or catchment basin, sufficient to contain the capacity of the largest single compartment <br /> or container with sufficient freeboard to contain precipitation. <br /> Provided all mobile or portable oil storage containers with secondary containment as required by the SPCC plan. <br /> The secondary containment must be capable of containing the capacity of the largest single compartment or <br /> container and have sufficient freeboard to contain precipitation. <br /> Page 10 of 11 <br />
