LAND USE AND PLANNING. <br /> Would the project: <br /> a) Physically divide an established community? ❑ ❑ ❑ FX_1 0 <br /> b) Cause a significant environmental impact due to a conflict <br /> with any land use plan, policy, or regulation adopted for the ❑ ❑ ❑X ❑ ❑ <br /> purpose of avoiding or mitigating an environmental effect? <br /> Impact Discussion: <br /> a,b) This project is comprised of three components. General Plan Map Amendment No. PA-2100226 proposes to <br /> change the General Plan land use designation from General Agriculture (AIG) to Truck Terminal (IIT). Zone <br /> Reclassification No. PA-2100227 to proposes to change the Zoning Designation from General Agriculture, 40-acre <br /> minimum (AG-40) to Truck Terminal (I-T). Use Permit No. PA-2100228 (UP) to establish the use of a Truck <br /> Terminal. The project is proposed on adjacent parcels under common ownership. Therefore, project will not <br /> physically divide an established community and is consistent with surrounding land uses. <br /> The current General Plan designation is AIG, and the current zoning is AG-40 (General Agriculture, 40-acre <br /> minimum). The Truck Terminal use type is not consistent with the parcel's current General Plan and zoning <br /> designations. if the General Plan designation is changed to IIT and zoning to I-T as proposed, then the development <br /> project will be consistent with the County's General Plan. The proposed project will have a less than significant <br /> impact to surrounding parcels and will not create premature development pressure on surrounding agricultural lands <br /> to convert land from agricultural uses to non-agricultural uses. Therefore,this project is not a growth-inducing action. <br /> Pursuant to Development Title Section 9-701.040(c), agricultural mitigation shall be satisfied by granting a farmland <br /> conservation easement or other farmland conservation mechanism set forth in San Joaquin County Development <br /> Title Section 9-701.040(d) or for the benefit of a Qualifying Entity. The number of acres of agricultural mitigation <br /> land shall be at least equal to the number of acres that will be changed to a nonagricultural use (1:1 ratio). <br /> The City of Lathrop has an approved plan called the North Lathrop Transportation Fee (NLTF'), a fee based on new <br /> vehicle trips associated with new development projects. This fee was adopted by the City of Lathrop City Council. <br /> However, the fee was never adopted by the San Joaquin County Board of Supervisors. As a result, the NLTF is not <br /> applicable to development projects within the boundaries of unincorporated San Joaquin County. The proposed <br /> project will not be a conflict with any existing or planned uses or set a significant land use precedent. The proposed <br /> project is not in conflict with any Master Plans, Specific Plans, or Special Purpose Plans, or any other applicable <br /> plan adopted by the County. <br /> 17 <br />
