PLANNING COMMISSION MINUTES <br /> SEPTEMBER 16, 1993 <br /> 2 . CERTIFICATION OF FINAL ENVIRONMENTAL IMPACT REPORT NO. ER-92-4 <br /> AND USE PERMIT APPLICATION NO. UP-91-12 OF FORWARD, INC. : ( 1 ) <br /> Certification of a Final Environmental Impact Report that addresses <br /> the environmental effects of the underlying Use Permit project; and <br /> (2) A Use Permit to modify approved Use Permit No. U-73-9 for an <br /> existing landfill and transfer/recycling station. The project site <br /> is located on the west side of Austin Road, two miles south of Arch <br /> Road, southeast of Stockton (Supervisorial District 4) . <br /> Associate Planner Chandler Martin introduced a staff report into <br /> the record. <br /> Comms. Rojas and Fortney said they had visited the site with the <br /> applicant. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Attorney Tom Shephard, representing the applicant, was <br /> present and said that other representatives and consultants for the <br /> project were present to answer questions. Mr. Shephard said he <br /> found the EIR to be adequate for the purposes of issuing the <br /> permit. He displayed graphics in support of the project. He said <br /> he believed the site would be in operation for 20 years. <br /> Lawrence Stefani (2535 Lakeview Dr. ) said he is the site manager <br /> and he explained the clean up program for the facility. <br /> Carrie Fisher (1145 W. Charter Way) representing Forward, Inc. , <br /> spoke on restrictions of reopening certain closed areas. <br /> Mr. Shephard said the closure process is subject to the regulations <br /> -of the State of California and the Environmental Protection Agency <br /> of the United States. It is not subject to consideration by the <br /> County. <br /> Comm. Zunino asked how many acres would be changed to Class 2 . Ms. <br /> Fisher said that there would be a reclassification of 20 acres <br /> south of the creek, and 50 or 60 acres northof the property. <br /> In answer to a question, Mr. Shephard said there are two residences <br /> within 500 feet of the property and that Forward, Inc. rents one of <br /> them. <br /> OPPONENTS: Bob Lynch (9606 E. Lynch Rd. , Manteca) said his <br /> property is 1/2 mile from Forward and it is downwind. He was <br /> concerned over traffic hazard, litter, odor and the ruination of <br /> good farm land. He said that the facility should not be expanded. <br /> Paul Sanguinetti (7677 E. Highway 4) , speaking in behalf of the <br /> Collegeville Fire Department, said that the subject property is not <br /> in the Collegeville Fire District, but if there is a fire, that <br />
