Item No. 2 <br /> PC: 9-16-93 <br /> UP-91-12/ER-92-4 <br /> Page 1 <br /> RECOMMENDATION <br /> It is recommended that the Planning Commission: <br /> 1. Certify the project's Final Envionmental Impact Report (EIR) No. ER-92-4 as adequate under <br /> the provisions of Section 15090 of the California Environmental Quality Act (CEQA) <br /> (Attachment A); <br /> 2. Approve Use Permit No. UP-91-12 with the Findings and Conditions of Approval given In the <br /> staff report; <br /> 3. Adopt"Findings of Significant Environmental Impact" (Attachment B); <br /> 4. Adopt the "Statement of Overriding Consideration" (Attachment C); and <br /> 5. Adopt the "Mitigation Monitoring Program" (Attachment D). <br /> FINDINGS FOR THE USE PERMIT <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan <br /> and any applicable Specific Plan or Special Purpose Plan. <br /> • This finding can be made because the proposed landfill modifications are consistent <br /> with the A/G (General Agriculture) designation of the site. No Specific Plan or Special <br /> Purpose Plan applies. <br /> 2. Adequate utilities,roadway improvements,sanitation,water supply,drainage,and other necessary <br /> facilities have been provided, and the proposed improvements are property related to existing and <br /> proposed roadways. <br /> • This finding can be made because the site has frontage on Austin Road, and the <br /> provision of adequate drainage, utilities, water, and sanitation have been shown on <br /> the site plans or are included in the project description or the Conditions of Approval. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the site contains 157 acres, and the site plans <br /> demonstrate that, with the Conditions of Approal, all required setbacks will be met. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> • Staff can make this finding because the EIR prepared for this project included <br /> mitigation measures that reduce impacts to the public health, safety, or welfare, or <br /> injuries to the property or improvementas of adjacent properties, to less than <br /> significant levels, with the exception of aesthetics and air quality. <br />
