Item No. 2 PC: 9-16-93 UP-91-12/ER-92-4 Page 1 RECOMMENDATION It is recommended that the Planning Commission: 1. Certify the project's Final Envionmental Impact Report (EIR) No. ER-92-4 as adequate under the provisions of Section 15090 of the California Environmental Quality Act (CEQA) (Attachment A); 2. Approve Use Permit No. UP-91-12 with the Findings and Conditions of Approval given In the staff report; 3. Adopt"Findings of Significant Environmental Impact" (Attachment B); 4. Adopt the "Statement of Overriding Consideration" (Attachment C); and 5. Adopt the "Mitigation Monitoring Program" (Attachment D). FINDINGS FOR THE USE PERMIT 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan and any applicable Specific Plan or Special Purpose Plan. • This finding can be made because the proposed landfill modifications are consistent with the A/G (General Agriculture) designation of the site. No Specific Plan or Special Purpose Plan applies. 2. Adequate utilities,roadway improvements,sanitation,water supply,drainage,and other necessary facilities have been provided, and the proposed improvements are property related to existing and proposed roadways. • This finding can be made because the site has frontage on Austin Road, and the provision of adequate drainage, utilities, water, and sanitation have been shown on the site plans or are included in the project description or the Conditions of Approval. 3. The site is physically suitable for the type of development and for the intensity of development. • This finding can be made because the site contains 157 acres, and the site plans demonstrate that, with the Conditions of Approal, all required setbacks will be met. 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be injurious to the property or improvements of adjacent properties. • Staff can make this finding because the EIR prepared for this project included mitigation measures that reduce impacts to the public health, safety, or welfare, or injuries to the property or improvementas of adjacent properties, to less than significant levels, with the exception of aesthetics and air quality.
