The Corps or Applicant, as appropriate will prepare and submit to the Service for <br />approval, a fisheries protection plan to monitor and protect delta smelt that may be <br />affected by in -water work outside of the complete avoidance window of August 1 to <br />November 30. Aspects of the plan may include screening, monitoring, fish salvage <br />methods, and reporting. This plan must be approved by the Service in writing prior to the <br />onset of work, with the exception of the Smith Canal gate test sheetpile installation in <br />2019. <br />4. The Corps or Applicant, as appropriate will prepare and submit to the Service for <br />approval, a sampling plan designed to detect any delta smelt that may be using Smith <br />Canal or Fourteenmile Slough. The general parameters of this sampling are that it should <br />be limited to three seasons, of which at least one season will be before project <br />construction of the gate element in each location, and the post -construction sampling is <br />to be conducted no later than three years after construction. The plan should be focused <br />on enhanced detection of smelt in these locations, using the most sensitive methods <br />that can be reasonably implemented, and done at times and under conditions with <br />the highest likelihood of smelt presence. This plan must be approved by the Service in <br />writing prior to the onset of monitoring. <br />14. CHANGE the following in Reporting Requirements, beginning on p. 35, as follows: <br />From: <br />Reporting Requirements <br />In order to monitor whether the amount or extent of incidental take anticipated from <br />implementation of the project is approached or exceeded, the Corps shall adhere to the following <br />monitoring requirements. Should this anticipated amount or extent of incidental take be <br />exceeded, the Corps must reinitiate formal consultation as per 50 CFR 402.16. <br />1. The Service must be notified within one (1) working day of the finding of any injured or <br />dead listed species or any unanticipated damage to its habitat associated with the <br />proposed project. Notification will be made to the Assistant Field Supervisor of the <br />Endangered Species Program at the Bay Delta Fish and Wildlife Office at <br />(916) 930-5604, and must include the date, time, and precise location of the <br />
