III sections 66262.34. <br />Cee. Defendants shall clearly and visibly mark each tank or container of <br />hazardous waste generated or stored at Defendants' Facilities with the following information: (i) the <br />tank or container shall be labeled, "HAZARDOUS WASTE; (ii) the date upon which each period of j <br />accumulation began; (iii) the date the applicable accumulation period began" (iv) the physical state <br />of the wastes; (v) a statement of the hazardous properties of the waste, e.g. "flammable, reactive, etc.; <br />and the name and the name and address of the Facility producing the waste as required by California <br />Code of Regulations, title 22, sections 66262.34(d). <br />fff Defendants shall assure all containers holding hazardous waste are always <br />1011 closed except when it is necessary to add or remove waste as required by California Code of <br />1111 Regulations, title 22, sections 66262.34(d). 40 CFR §§262.34 and 265.173. <br />ggg. Defendants shall prepare and file a hazardous waste manifest, with the <br />Department of Toxic Substance Control ("DTSC") within thirty (30) days of submitting hazardous <br />14 waste for transportation, for all hazardous waste that is transported, or submitted for transportation, <br />15 to offsite handling, treatment, storage, disposal, or any combination thereof, from any Facility, as <br />16 required by Health and Safety Code section 25160(6)(3) and California Code of Regulations, title 22, <br />17 section 66262.23. <br />is hhh. Defendants shall contact the owner or operator of the hazardous treatment, <br />19 storage, disposal facility where hazardous waste from Defendants Facility was shipped to determine <br />20 the status of the hazardous waste, in the event Defendants have not received a copy of the manifest <br />21 signed by all transporters and the facility operator within thirty-five (35) days of the date the waste <br />22 was accepted by the initial transporter, as required by Health and Safety Code section 25160(b)(3) <br />231, and California Code of Regulations, title 22, section 66262.42. <br />iii. Defendants shall file an exception report concerning the transportation of a <br />2511 hazardous waste to a treatment, storage, or disposal facility when the facility has failed to return any <br />executed manifest, as required by Health and Safety Code section 25160(b)(3) and California Code <br />2711 of Regulations, title 22, section 66262.42. <br />2811 jjj.
