III potential for a release to the environment, Defendants shall take all appropriate action to prevent a <br />release, including, but not Iimited to, shutting down the effected portion of the UST system and <br />311 removing the hazardous substance. <br />bb. Defendants shall affix to its monitoring equipment all required tags and <br />stickers showing completion of the testing described in Paragraph x above. <br />cc. In conducting secondary containment system testing, Defendants shall <br />711 follow the recommended procedures of the relevant UPA as they relate to containment sump wall <br />seams and penetrations. In the event that Defendants are unsure of the UPA's recommended <br />9 procedures, they shall contact the relevant UPA and obtalin written clarification, <br />1p dd. Defendants shall submit a complete copy of the test report for secondary <br />11 containment system testing for any Facility they own or operate to the relevant UPA within the time <br />I2 required by California Code of Regulations, title 23, section 2637- <br />13 ee. Defendants shall at all times employ a qualified "designated UST operator" <br />14 for each UST location owned and/or operated by Defendants as required by California Code of <br />15 Regulations, title 23, section 2715(b), and shall identify the designated UST operator to the relevant <br />16 UPA as required by California Code of Regulations, title 23, section 2715(a). <br />17 f£ Defendants shall ensure that a qualified designated UST operator performs <br />18 a monthly visual inspection of every UST system as required by California Code of Regulations, title <br />19 23, section 27I6(a) and conducts the training required by California Code of Regulations, title 23, <br />section 2715(c). <br />2111 gg. Defendants shall ensure that the designated UST operator has access to all <br />materials (including, but not limited to, alarm history reports and Iogs), all areas of the Facility and <br />2311 all employees necessary for the designated UST operator to complete the tasks required by California <br />Code of Regulations, title 23, sections 2715 and 2716. <br />2511 hh. Defendants shall address any maintenance, repair or testing issues <br />2611 identified by the designated UST operator during the monthly inspection as required by law. <br />ii.
