I of the UST system at least once every twelve months and that before any new employee begins work <br />2 at one of these Facilities, they have received this training as required by California Code of <br />3 Regulations, title 23, section 2715(c). <br />4 J. Defendants shall fill out the bottom portion of each designated UST <br />5 operator visual inspection report within 72 hours of receiving that report. Defendants must provide a <br />6 description of each corrective action taken or that will be taken to address any compliance issue noted <br />7 in the designated UST operator report and they must sign and date that report acknowledging the <br />8 results of the monthly inspection as required by California Code of Regulations, title 23, section <br />2716(e). <br />10 kk. Defendants shall submit any proposed upgrade or repair of a UST system <br />11 or change of equipment to the UPA for its approval as required by California Code of Regulations, <br />12 title 23, section 2660 and shall obtain the UPA's approval before proceeding, pursuant to California <br />13 Code of Regulations, title 23, section 2662(a). If Defendants are unsure whether UPA approval is <br />14 required for work on a UST system, they may request clarification from the UPA in writing. <br />15 It. Defendants shall maintain and make available for review by the UPA, all <br />16 written monitoring and maintenance records as required by California Code of Regulations, title 23, <br />17 section 2712(b). <br />18 mm. Defendants' UST systems shall meet the applicable operational <br />19j, requirements set forth in Health and Safety Code sections 25292.1(a), 25290.2, 25291 and 25292. <br />20 <br />21 <br />22 <br />23 <br />nn. For any unauthorized release, as defined in Health and Safety Code section <br />25295.5, Defendants shall record the unauthorized release, timely notify the UPA of the unauthorized <br />release and timely provide to the UPA a full written report of the unauthorized release as required by <br />Health and Safety Code sections 25294 and 25295(a)(1) and California Code of Regulations, title 23, <br />24 sections 2650 through 2652. <br />25 00. Defendants shall equip all USTs with a spill container and overfill <br />26 prevention system as required by California Code of Regulations, title 23, section 2635(b). <br />27 Defendants shall under no circumstances disable the drain valve required by California Code of <br />28 Regulations, title 23, section 2635(b)(1)(2), unless the spill container is provided with a means to keep <br />9 <br />11 Hassan & Sons, Inc., et al. lPrapasedl Final.iudgment and Permanent Injunction <br />
