Regulations, title 23, section 2712(1) and Health and Safety Code section 25284. <br />b. Pursuant to Health and Safety Code section 25286(a) and California Code <br />of Regulations, title 23, section 2712, Defendants shall comply with the terms of their UST permits, <br />including, but not limited to, timely notifying the UPA of any changes to the information provided. <br />C. In any permit application submitted pursuant to California Code of <br />Regulations, title 23, section 2711, Defendants shall provide complete and accurate information. If <br />Defendants learn that a permit application contains incomplete or inaccurate information, Defendants <br />shall, upon discovery, supplement their permit application so as to satisfy the requirements of <br />California Code of Regulations, title 23, section 2711. <br />10 d. Defendants shall maintain evidence of financial responsibility for taking <br />I 1 corrective action and for compensating third parties as required by Health and <br />12 Safety Code section 25292.2. <br />13 C. Defendants shall not operate a UST system without having in place a <br />14 monitoring and response plan approved by the UPA and specified in the UST operating permit as <br />15 required by California Code of Regulations, title 23, sections 2632(b) and 2641(g). <br />16 f. Defendants shall monitor the UST system at the Facilities that Defendants <br />17 own, operate, manage or control using the method specified in the permit as required by Health and <br />18Safety Code section 25293 and California Code of Regulations, title 23, sections 2632(b) and 2641(g). <br />19 g. Defendants shall at all times equip all secondary containmcnt, including <br />under -dispenser containment, and under -dispenser spill control or containment systems, with a <br />2111 continuous monitoring system that either activates an audible and visual alarm or stops the flow of <br />the hazardous substance at the dispenser when it detects a leak, as required by California Code of <br />Regulations, title 23, section 2636(f)(1). <br />h. All monitoring and leak -detecting equipment including, but not limited to, <br />2511 leak -detecting sensors shall be installed, calibrated, operated and maintained in accordance with the <br />2611 manufacturer's instructions as required by California Code Regulations, title 23, Section 2638(a). <br />27 i. All upgrades and repairs to any UST system including repair and/or <br />28 replacement of underground storage tanks, piping, or other UST components including leak -detection <br />d <br />Hassan & Sons, Inc., et al. [Proposed] Final Judgment and Permanent Injunction <br />
