It Ave F #C Z ' X1 .3 d� L Fax e Stockton,California 95201-3018 Review of Financial Assurance Demonstrations for the Harney Lane Sanitary Landfill,Foothill Sanitary Landfill,Corral Hollow Sanitary Landfill,and North County Recycling Center and sanitary Landfill,Facility Nos.39-AA-0003,39-AA-0004,39-AA-0005,and 39-AA-0022 Dear Mr.Carroll, The Financial Assurances Section of the California Integrated Waste Management Board( )is currently reviewing the financial assurance demonstration of the County's facilities in conjunction with the current permit review for the Foothill Sanitary Landfill. According to Title 27,Calif is Code of Regulations(CCR),section 22225,San Joaquin County is required to submit to the CIWMB,on or before each anniversary date,the anrival capacity filled and remaining facility capacity for each twelve-month deposit calculation. Our records indicate the anniversary of the establishment of the closure ftmd for the Foothill Sanitary Landfill and the North CountySanitary fill is September 1990. The latest record received of the balance of the funds is from 2001.In support of the latest balance information,the latest record of capacity utilized only supports the annual deposit calculation for the 2040 deposit to the fund.To complete the review of the adequacy of the ' d balances,please submit the annual capacity filled and remaining facility capacity for each twelve-month deposit calculation from September 2000 through the end of August 2004.The annual capacity filled and remaining facility capacity inforination is required by 27 CCR section 22225 to be submitted annually on or before the September 25 Fund anniversary date with the current fund balance information. FAS staff use this information to evaluate your data and confirm the minimum required balance. The establishment of the postclosure maintenance ftd for the Corral Hollow Sanitary ll is also September 1990.According to 27 CCR,section 22234, San Joaquin County is required to submit a written request for any release of monics from any Enterprise Fund.Please be aware t,unlike the Pledge of Revenue Agreement(Pledge),the operator,and the Auditor-Controller are under obligation to wait for CIWMB approval before accessing monics from the Funds. As San Joaquin County is utilizing the Pledge for the other County facilities,it may be possible to amend the postclosure maintenance demonstration for Corral Hollow Sanitary Landfill ftm an Enterprise Fund to a Pledge.
