Permit for the proposed use; <br />(3) In no case shall a parcel created under the provi- <br />sions of this section have an area of less than ten <br />(10) acres; <br />(4) No permit for residential use may be issued on any <br />parcel created under the provisions of this section <br />for a period of ten (10) years from the date of <br />approval of a Use Permit for one of the above uses, <br />unless the approval of the Use Permit for residential <br />uses which are accessory to and necessary for the <br />operation of a marina; <br />(e) In the GA -5, GA -10, GA -20, GA -40, GA -80 and GA -160 zones, <br />parcels of land with an area of less than ten (10) acres <br />may be further divided, subject to the following <br />conditions: <br />(1) Such parcels were severed from a larger parcel as a <br />result of the acquisition by the State or by local <br />government of a right-of-way for a public facility <br />such as a freeway, road or canal; <br />(2) Such parcels are owned by the persons from whom such <br />rights-of-way were acquired; <br />(3) Such parcels were created after the effective date of <br />ordinance No. 850 on February 8, 1961; <br />(4) Such parcels do not abut other parcels under the same <br />ownership as the severed parcels; <br />(5) The maximum number of parcels that may be created <br />pursuant to this Subsection shall be four (4); <br />(6) The minimum area of parcels created pursuant to this <br />Subsection shall be two and one-half (21) acres, sub- <br />ject to the exception that such parcels which have <br />terminal drainage shall have an area of not less than <br />two (2) acres; <br />(7) This Subsection (e) is repealed and shall be of no <br />further force and effect as of January 1, 1985, save <br />and except for applications for parcel maps pursuant <br />to this Subsection made prior to said date. <br />Source: Ordinance No. 850, 880, 893, 894, 1447, 1535, 1994, <br />2075, 2157, 3044, 3126. <br />SECTION 9-4105. WIDTH REGULATIONS.
