APRICOT ACRES <br />SU -86-12 <br />CONDITIONS OF APPROVAL <br />The following conditions of approval, unless otherwise noted, shall be <br />met prior to the filing of the final map. <br />1. Planning Division: <br />a. The Public Report filed with the State Department of Real <br />Estate shall indicate the current and possible increased <br />activity at the Tracy Municipal Airport and the related noise <br />potential from aircraft in the project area. <br />b. The Public Report filed with the State Department of Real <br />Estate shall reference the County's right -to -farm ordinance. <br />C. A noise reduction wall shall be constructed along the south <br />property line of the subdivision fronting on the Western <br />Pacific Railroad line. The noise barrier shall reduce the <br />noise level at the property line to 65 decibels, Ldn <br />(day -night average level). <br />d. Pursuant to Section 66474.9 of the Subdivision Map Act, the <br />subdivider shall defend, indemnify, and hold harmless the <br />local agency or its agents, officers, and employees frDm any <br />claim, action, or proceeding against the local agency or its <br />agents, officers, or employees to attack, set aside, void, or <br />annul an approval of the local agency, advisory agency, <br />appeal board, or legislative body concerning a subdivision, <br />which action is brought within the time provided for in <br />Section 66499.37 of the Subdivision Map Act. <br />2. Department of Public Works: <br />a. Fairoaks Road shall be widened on the subdivided side in con- <br />formance with the standards for a 50 -foot right-of-way farm <br />or estate road. <br />b. A master circulation plan shall be prepared for the area <br />approved by GP-86-1/ZR-87-34. The interior street layout <br />shall be incorporated into the master circulation plan and <br />constructed to County standards for 50 -foot right-of-way farm <br />or estate roads, and conform to one of the two alternative <br />layouts specified by the Department of Public Works and <br />agreed to by the developer. <br />C. The developer shall provide for storm drainage in accordance <br />with the Board of Supervisors' Resolution No. 76-4201 which <br />allows for the use of on-site storm drainage retention basins <br />on each lot. <br />SU -86-12 -2- Resolution #87-950 <br />
