Box 239 <br />Tracy, CA 95378 <br />TRIPLE E PRODUCE CO., TRACY, SAN JOAQUIN COUNTY <br />Your facility is discharging waste without a permit and is in violation of <br />Section 13260 of the California Water Code which requires that any person <br />discharging waste that could affect the quality of the waters of the State shall <br />file with the Regional Board a Report of Waste Discharge (RWD). Furthermore, <br />our investigation has concluded that your discharge of chlorinated wash water <br />has polluted the ground water and threatens to contaminate downgradient domestic <br />water supplies. <br />We request that you cease discharge of contaminated wastewater as soon as <br />possible and submit to us your short-term plan for treatment or disposal of this <br />wash water by 16 September. Additionally, we request that you submit a complete <br />RWD to us by 26 October. The RWD should include a characterization of your <br />waste(s) and a long-term disposal/treatment plan that will meet all the perti- <br />nent requirements. <br />Furthermore; pursuant to Section 13267 of the Water Code, you are requested to <br />submit a technical report to the Regional Board by 26 October that will serve as <br />a work plan to investigate and correct the ground water contamination from <br />your facility. The report should include but not necessarily be limited to the <br />following elements: <br />1. A domestic well survey and a monitoring plan that will detect the levels <br />of contamination in domestic wells down -gradient of your facility. <br />2. Characterization of the wastewater and waste sludge pit to determine if it <br />will be subject to the Toxic Pit Cleanup Act (TPCA) of 1984. We are <br />primarily concerned that the sludge in the pit may contain pesticide <br />residues. The characterization should also include analyses for volatile <br />organics, heavy metals, and hydrocarbon related compounds, as runoff from <br />the unloading area also drains into the pit. <br />
