"The proposed development and the surrounding areas <br /> are being considered for future development on septic <br /> systems and will concentrate large volumes of sewage <br /> effluent in the soil. Water quality for these con- <br /> centrated developments with existing soil types <br /> require adequate monitoring provided by law for public <br /> water systems. This safety feature would not be pro- <br /> vided by individual residential water wells. <br /> "Present legislation (AB 859 ) will extend the number <br /> of chemicals allowed in public water systems by 12. <br /> The Maximum Contaminant Level (MCL) will be <br /> established for these additional chemicals allowing <br /> for broader protection of the underground water <br /> aquifer. This extended protection will not cover <br /> individual residential water wells. <br /> "The public health of the future residents can be <br /> better served by retaining the conditions set forth in <br /> the Health District' s recommended conditions. " <br /> Summary of Basis of Appeal: The applicant respectfully <br /> requests that these conditions of approval be deleted from <br /> the Major Subdivision tentative map approval. Condition <br /> No. l. a. (Tracy Airport notification) is irrelevant. <br /> Condition No. l.d. (Subdivider indemnity) is unfair and <br /> immoral, and probably unconstitutional ) . Condition No. <br /> 2 . b. (master circulation plan) is not understood. <br /> Condition No. 2. c. (master drainage system) is not needed. <br /> Condition No. 2. d. (public water system) is not needed. <br /> Condition No. 3. c. (test well ) is not needed. <br /> Summary of Response: The Public Works Department responds <br /> as follows: <br /> "The Environmental Impact Report (ER-86-3 ) for this <br /> project and the surrounding area was certified by the <br /> Board of Supervisors on August 27, 1987. The EIR has <br /> identified impacts and mitigation measures to reduce <br /> the impacts. Public Works ' conditions of approval for <br /> the subdivision, regarding storm drainage, water <br /> system and master circulation plan, are developed in <br /> consideration of the information and mitigation <br /> measures recommended in the EIR. The potential <br /> development to rural residential (GP-88-13/ZR-88/11) <br /> for approximately 410 acres in the area is another <br /> major consideration of our conditions. Our recommen- <br /> dations for public water and drainage systems are <br /> based on our professional engineering judgment and <br /> consistent with adopted County Development Policies.
