OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests (UHWM): -006362134GBF, 11/22/2019 -021823768JJK, 6/25/2020 -022516648JJK, 2/11/2021 REGULATION GUIDANCE: (a)A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (c)A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste is submitted,within 60 days from the date that the hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the manifest,with some indication that the generator has not received confirmation of delivery. (d)Generators shall submit the information to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator. DTSC address is DTSC Report Repository, Generator Information Services Section, PO Box 806, Sacramento, CA 95812-0806. Provide a corrective action statement to the EHD within 30 days. This is a repeat violation, Class ll. 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste transported from the site in the past three years. The missing receipts include: used oil, oily absorbent, paper oil filters, and metal oil filters. REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. This period of retention is extended automatically during the course of any unresolved enforcement action regarding the regulated activity or as requested by the department or a certified unified program agency. CORRECTIVE ACTION: Locate a copy of the receipts listed above from 12/27/2018-12/27/2021. Maintain the records on-site for three years from the date of shipping and provide a copy to the San Joaquin County Environmental Health Department(EHD). If the receipts cannot be found, provide a statement to the EHD that future receipts will be maintained on-site for three years. This is a repeat violation, Class ll.
