Box 1810 <br /> Stockton, CA 95201 <br /> FINANCIAL ASSURANCE MECHANISMS REVIEW FOR FOOTHILL SANITARY LANDFILL, <br /> SAN JOAQUIN COUNTY <br /> The Central Valley Regional Water Quality Control Board (Central Valley Water Board) has <br /> reviewed the Financial Assurance Mechanisms for the Foothill Sanitary Landfill. San Joaquin <br /> County Public Works submitted the Financial Assurances as required in Provision 12E of <br /> Waste Discharge Requirements Order No. R5-2003-0020. Foothill Sanitary Landfill is an <br /> operating landfill in eastern San Joaquin County and must provide Financial Assurances in <br /> accordance with Title 27, §22205 (closure), §22210 (post-closure), §22215 (operating liability), <br /> and §22220 (corrective action). <br /> Financial assurance for closure for the Foothill Sanitary Landfill is provided by an Enterprise <br /> Fund, San Joaquin County Resolution No. R-90-1190. Postclosure maintenance financial <br /> assurance is provided by a Pledge of Revenue Agreement No. 94-1137,and operating liability <br /> is provided by a non-expiring certificate of Self-Insurance and Risk Management. Corrective <br /> action financial assurance is currently provided by a non-expiring certificate of Self-Insurance <br /> and Risk Management. San Joaquin County has adjusted the approved cost estimate for <br /> corrective action using the California Integrated Waste Management Board (CIWMB) inflation <br /> factor increasing the cost to reflect 2007 dollars. Staff agrees with the adjusted increase in <br /> corrective action cost. <br /> San Joaquin County has determined the Self-Insurance and Risk Management financial <br /> mechanism used for corrective action is inappropriate for this purpose, and has taken steps to <br /> change the mechanism to Pledge of Future Revenue. The use of the Pledge of Revenue <br /> mechanism must comply with Title 27, §22245 a-d. San Joaquin County Public Works is <br /> seeking Board of Supervisors approval to change the mechanism. Once the Board of <br /> Supervisors has approved the Pledge of Future Revenue, please submit the appropriate <br /> documentation to the CIWMB and provide a copy to the Central Valley Water Board staff. <br /> The financial assurances for closure, post-closure, operating liability, and corrective action <br /> appears appropriate and is provided to the Central Valley Water Board for review in <br /> accordance with Title 27. <br /> California Environmental Protection Agency <br /> 0 Recycled Paper <br />
