This gas well along with a few others were included in a CPCMP which was submitted and approved by the agencies. It seems we would be able to accept what has been proposed (with respect to SG-12) until such time gas is detected in the probes at which time a well to the depth of waste/refuse is to be installed to replace SG-12. I have not had a chance to talk to Mike Wochnick to see excatly what was discussed. If the site is not certified closed and/or there is no approved Closure Plan, then the entire site seems to need to be brought in compliance with the revised gas regs. but again, let me first find out what was discussed between Mike Carroll and my supervisor, after which I'll get back to you and Robert. What do you think? Here is my take: 1. Mr. Carrol cited section 20921(b)(2)(A)for his exemption. I don't think it applies to Foothill. Foothill is still taking waste thus the ...(b)(2)does not apply. ...(b)(2) states"... disposal sites which have received their final shipment of waste ..... Also according to Robert, Foothill or Mr. Carrol has not submitted or have the final closure plan approved on or before September 20, 2007 as stated in ...(b)(2)(A). 2. Section 20921(b)(1) is more applicable to Foothill. It states"New disposal sites and lateral expansions of existing disposal sites...." What is your take on this? 1/8/2009
