In determining whether a violation is <br /> chronic or a violator is recalcitrant , the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 ( not including <br /> corrective action ) . <br /> On 6/21 /2022 , Carol Presto of San Joaquin County Environmental Health Department (EHD) issued a Notice of Significant Violation to the above <br /> referenced site . Carol spoke with manager Kenny Dietz on the phone regarding notice and was signed off on by cashier, Vincent Perez. The site was <br /> given 7 days from receipt of the notice to comply or the entire UST system would be red tagged . The site continues to be out of compliance for the <br /> following : <br /> - On the 5/30/2019 and 5/18/2020 inspection reports , the facility was cited for not having approved overfill on all tanks . An Overfill Prevention Equipment <br /> Inspection Report Form was submitted to EHD on 5/12/2020 for testing conducted on 5/2/2019 but 48-hour notification was not provided for the test, <br /> work orders for the test and a copy of the results were not on site during the 5/18/2020 inspection. The overfill equipment listed on the result was OPW <br /> 61 SO but flappers were not observed during the 5/18/2020 and 5/26/2021 inspections . New Franklin Fueling Defender drop tubes were installed under <br /> permit number SR0083186 but by a technician not certified by the manufacturer.
