Per Pruven Parsad, Line Haul <br /> Manager,the driver was washing his truck with a hose connected to a spigot on the fuel island between dispenser <br /> #2 and#3. Observed spill washed into the storm drain. <br /> REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br /> receive initial and annual refresher training.All employees shall be trained in safety procedures in the event of a <br /> release or threatened release of a hazardous material, including, but not limited to,familiarity with the following <br /> plans and procedures: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br /> years. <br /> CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br /> training records to the EHD. <br /> This is a Class II violation. <br /> 12 HSC 25505(c)Failed to have the HMBP readily available to facility or EHD personnel. <br /> OBSERVATION: Facility could not provide the Emergency Response Plan and the inventory information upon <br /> request. <br /> REGULATION GUIDANCE: The emergency response plans and procedures,the inventory of information required <br /> by this article, and the site map required by this section shall be readily available to personnel of the business or the <br /> unified program facility with responsibilities for emergency response or training pursuant to this section. <br /> CORRECTIVE ACTION: Immediately make arrangements to have the business plan readily available for review. <br /> This is a repeat violation, Class II. <br /> Overall Inspection Comments: <br /> On-site for a Emergency Response inspection. Conducted a Hazardous Materials Business Plan (HMBP) <br /> inspection. There were 4 violations during the inspection. Complete and submit a copy of the Return to <br /> Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or <br /> will be taken for each violation, and any supporting paperwork, by 5/5/2022. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
