Mr. Kevin Neal - 3 - 15 May 2002
5. Submit a plan to cleanup the sediments discharged into Patterson Run and Wetlands
Area"C" to the California Department of Fish and Game for its review and approval.
We urge you to address these storm water issues immediately. By 14 June 2002, we request that
you submit a copy of the SWPPP, a report describing how each issue above was addressed, and
the sediment cleanup plan. The report must include photographic evidence of implementation of
BMPs and good housekeeping measures. We request that you submit a copy of the SWPPP and
sediment and cleanup plan, and report to the following address:
Attn: Philip S. Isorena
Central Valley RWQCB
3443 Routier Road, Suite A
Sacramento, CA 95827-3003
Also by 14 June 2002,we request that you submit the sediment and cleanup plan to the
California Department of Fish and Game at the following address:
Attn: Dale Watkins
Department of Fish and Game
Sacramento Valley-Central Sierra Region 2
1701 Nimbus Road
Rancho Cordova, CA 95670
Under Section 13385 of the California Water Code, the Regional Board can impose
administrative civil liabilities for violations of the General Permit. The maximum fine for each
day of violation is ten thousand dollars ($10,000). Additional liability of up to $10 per gallon of
waste discharged, in excess of 1,000 gallons, maybe assessed.
On a related matter, our storm water database shows that you have not filed a notice of intent
(NOD for the auto auction operation at the site. The General Industrial Permit(NPDES
No. CAS000001) requires that you develop and implement a SWPPP before you begin operation.
Due to the large number of vehicles proposed to be stored at the 230-acre site, significant
amounts of pollutants could be discharged. Figures 17 and 18 show major erosion and
sedimentation caused by the discharge from the large parking lot surrounding the paint and body
shop, and northwest of Wetlands Area C. Therefore, appropriate BMPs, which would likely
include treatment control BMPs for the treatment of pollutants associated with automobiles, must
be in place prior to start of operation.
If you have any questions, you may call Philip S. Isorena at(916)255-3398 or e-mail him at
isorenp@rb5s.swrcb.ca.gov.
gov.
A?
