Storm water discharges and authorized nonstorm water discharges to any surface or <br /> ground water shall not adversely impact human health or the environment." <br /> The inspection also found inadequate implementation of storm water Best Management Practices <br /> (BMPs) for erosion and sediment control. Failure to implement controls or BMPs in accordance <br /> with the Storm Water Pollution Prevention Plan(SWPPP) is a violation of Special Provision C.2 <br /> which states, <br /> `All dischargers shall develop and implement a SWPPP in accordance with Section A: <br /> Storm Water Pollution Prevention Plan. The Discharger shall implement controls to <br /> reduce pollutants in storm water discharges from their construction sites to the BAT/BCT <br /> performance standard." <br /> Failure to implement BMPs on disturbed soil is a violation of Section A.7.1 which states, <br /> "All disturbed areas of the construction site must be stabilized." <br /> In addition,the discharge of sediments to surface waters or surface water drainage <br /> courses is a violation of Section A.8 which states, <br /> "At a minimum, the discharger/operator must implement an effective combination of <br /> erosion and sediment control on all disturbed areas during the rainy season." <br /> Furthermore, not conducting regular site inspections is a violation of Section A.11 and Section <br /> B.3,which state, <br /> "Inspections will be performed before and after storm events and once each 24-hour <br /> period during extended storm events to identify BMP effectiveness and implement repairs <br /> or design changes as soon as feasible depending upon field conditions." <br /> In response to this Notice of Violation (NOV), we expect you take the following corrective <br /> actions: <br /> 1. Implement the SWPPP immediately. Make the SWPPP available at the construction site <br /> at all times. <br /> 2. Inspect the site before each anticipated storm event, during an extended storm event, and <br /> after each storm event to ascertain that BMPs are being effective in controlling the <br /> discharge of sediment and construction materials into surface water or surface water <br /> drainage courses.However, inspection should not be limited to the wet season.You are <br /> required to implement the SWPPP year round until we issue a notice of termination for <br /> the site. Inspection reports must be included in the SWPPP and retained for at least three <br /> years or until the site receives a notice of termination,whichever comes first; <br /> 3. Ensure that all disturbed soil, slopes, roadways, and creek banks are completely <br /> stabilized; <br /> 4. Ensure that soil,waste, and construction material piles have adequate controls and are <br /> prevented from being discharged to surface water or surface water drainage courses; and <br />
