DA-90-1 <br /> OF TRACY INDUSTRIAL PROPERTIES (CIO ADT AUTOMOTIVE) <br /> (FIFTH SUPERVISORIAL DISTRICT) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors: <br /> 1. Approve the Negative Declaration; <br /> 2. Approve Special Purpose Plan Amendment No. PP-99-2, with the Conditions of Approval, based <br /> on the ability to make the Basis for Special Purpose Plan (Attachment "A"); and <br /> 3. Approve Development Agreement Amendment No. DA-90-1 based on the ability to make the <br /> Findings(Attachment"B"). <br /> BACKGROUND: <br /> The Patterson Pass Business Park(Park) consists of approximately 610 acres between the California <br /> Aqueduct and the Delta Mendota Canal, bisected by Mountain House Parkway. The Patterson Pass <br /> Special Purpose Plan, adopted in 1994, includes 128 acres. The Plan includes 80 acres on the west side <br /> of Mountain House Parkway and 48 acres on the east side of Mountain House Parkway. <br /> In 1990, San Joaquin County and the developers of the business park entered into an agreement which <br /> set forth specific obligations to both parties regarding the development of the Park. The Development <br /> Agreement originally included the area east of Mountain House Parkway except the Safeway properties. <br /> Safeway entered into a similar but separate agreement. The Development Agreement was amended in <br /> 1992 to add 80 acres west of Mountain House Parkway. <br /> SOS LETTER PAGE 1 <br />
