i <br /> N� <br /> REASON FOR RECOMMENDATION: <br /> This project consists of two parts. The first part is an amendment of the May, 1994, Patterson Pass <br /> Business Park Special Purpose Plan to add approximately 204 acres to the Special Purpose Plan's 128 <br /> acres of land to accommodate a large auto auction facility. The amendment will not affect the area that <br /> is already within the Special Purpose Plan. However, relative to the 204 acre addition, the proposed <br /> amendment will: <br /> Modify the circulation plan by eliminating the loop and a cross road within the project site. <br /> • Delete the water service, and storm drainage lines that would have followed the circulation plan; and <br /> stub the sewage disposal and water service lines at the south end of the project site. <br /> • Provide for storm drainage improvements, including the deletion of an indicated temporary detention <br /> basin and the addition of a 54 acre-foot permanent detention basin. <br /> Provide a Visual Resource Analysis(by reference)with landscaping to soften the visual impacts from <br /> 1-205 and 1-580. <br /> • Provide for the proposed improvements of the project site with the ADT auto auction facility. <br /> • Provide for pre-construction surveys for San Joaquin Kit Fox, the protection of the Patterson Run, <br /> and the delineation and protection of wetlands areas. <br /> • Identify further permits that will be required from the Army Corps of Engineers, the California <br /> Department of Fish and Game, the U. S. Fish and Wildlife Service, and the Central Valley Regional <br /> Water Quality Control Board. <br /> The amendment to the Development Agreement has four provisions: <br /> 1. Addition of Property. This provision adds the 204 acre project site to the Development <br /> Agreement. <br /> 2. Additional Existing Approvals. This provision adds 20 approvals relative to the project site and <br /> the area within the boundaries of the original Development Agreement. The approvals include <br /> the Patterson Pass Business Park Special Purpose Plan, this amendment to the Special Purpose <br /> Plan, this amendment to the Development Agreement, the General Plan and Rezone approved <br /> by the Board of Supervisors on September 12,2000, and several Maps, Mergers and Lot Line <br /> Adjustments. <br /> 3. Effective Date. This provision sets the effective date as the date of the amendment Enacting <br /> Ordinance and provides for recording the Amendment. <br /> 4. No Further Modifications. This provision provides for the remainder of the Development <br /> Agreement to remain in full force and effect. <br /> s <br /> The Planning Commission heard this matter at its meeting of September 7, 2000. Mike Hakeem, <br /> attorney for the applicant, Chuck McCallum, engineer for the project, Gary Mogley, site manager for <br /> ADT, and Michael Locke, San Joaquin Partnership, spoke in favor of the project. No one spoke in <br /> opposition. The Planning Commission voted 5-2 to refer this item to the Board of Supervisors with a <br /> recommendation for approval.
