BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN <br />STATE OF CALIFORNIA <br />R -87-_L _, <br />RESOLUTION ANNEXING TERRITORY TO MOKELUMNE ACRES <br />MAINTENANCE DISTRICT OF SAN JOAQUIN COUNTY (BENSON PLACE) <br />WHEREAS, Mokelumne Acres Maintenance District was formed <br />pursuant to the provisions of Division 7 of the Streets and <br />Highways Code of the State of California (The Improvement Act of <br />1911) and is currently authorized to provide domestic water and <br />storm water drainage services; and, <br />WHEREAS, as a result of Petition to annex to this District <br />submitted by the landowners of the hereinafter described terri- <br />tory, this Boardf Supervisors did, on October 20, 1987, adopt <br />Resolution R-87- entitled "Resolution of Intention to Annex <br />Territory to Mokelumne Acres Maintenance District", and a <br />Notice of the adoption of said Resolution of Intention was duly <br />given by the County Department of Public Works as shown by the <br />proof of publication and by the certificates of posting and of <br />mailing, all on file with this Board of Supervisors; and, <br />WHEREAS, the Public Hearing was duly held on said matter and <br />evidence, both oral and documentary, was received and considered <br />in favor of the annexation, and no objections or protests, either <br />written or oral, were filed or made against said annexation, and <br />the Board having found that Notice has been given as required by <br />law; <br />NOW, THEREFORE, BE IT RESOLVED that this Board does hereby <br />determine, that the territory hereinafter described is contiguous <br />to the existing Mokelumne Acres Maintenance District, is unincor- <br />porated territory of the County of San Joaquin, will be benefited <br />by annexation to said District, and is not subject to any exist- <br />ing bonded indebtedness, but is subject to the existing contrac- <br />tual agreement between said District and the Pacific Gas and <br />Electric Company. <br />BE IT FURTHER RESOLVED that pursuant to Section 54790.3 of <br />the Government Code there is no transfer of property tax revenues <br />as a result of this annexation. <br />IT IS, THEREFORE, HEREBY ORDERED by this Board of <br />Supervisors that the territory described in said Resolution of <br />Intention adopted October 20, 1987, be, and it is hereby, <br />annexed to said District, and that the territory hereby annexed <br />to Mokelumne Acres Maintenance District is described as set forth <br />in Exhibit "A" attached hereto and made a part hereof and as <br />shown upon map marked Exhibit "B" attached hereto and made a part <br />hereof. <br />
