SAN JDARIN <br /> Environmental Health Department <br /> u i Y <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> BILLJAR VALERO 153 E ELEVENTH ST,TRACY January 26, 2022 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br /> Environmental Reporting System (CERS)annually by the due date, January 15. <br /> •The 2022 business plan submittal has not been submitted.The last submittal was 2/27/2021. <br /> •The 2021 business plan submittal was on time on 1/15/2021 <br /> •The 2020 business plan submittal was on time on 12/20/2019 <br /> REGULATION GUIDANCE: The hazardous materials business plan shall be submitted by January 15 of each <br /> calendar year and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/to review and submit the <br /> Facility Information, Hazardous Materials Inventory, and Emergency Response and Training Plan sections to the <br /> EHD for approval. <br /> This is a minor violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> OBSERVATION: HMBP training records were only found for the year 2021. <br /> REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br /> receive initial and annual refresher training.All employees shall be trained in safety procedures in the event of a <br /> release or threatened release of a hazardous material, including, but not limited to,familiarity with the following <br /> plans and procedures: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br /> years. <br /> CORRECTIVE ACTION: Ensure training is being conducted annually, being documented, and records of training <br /> are kept for a minimum of 3 years.
