RECEIVED ON 09/02/2022 VIA EMAIL <br /> 208 CCR 2716(a-e)Failure to comply with the designated operator inspection requirements. <br /> OBSERVATION:Designated operator reports were not signed within the required time frame <br /> -The 612112021. 10il712021, 12 1212021 and 3!712022 designated operator reports were not signed by the <br /> ownerioperator <br /> REGULATORY GUIDANCE:Within 48 hours of the completion of the designated UST operator visual inspection. <br /> the designated operator shall sign and provide the owner or operator with a copy of the inspection report Within 72 <br /> hours of being provided a signed copy of the report,the owner or operator shall provide a description of each <br /> corrective action taken or to be taken and shall sign and date the report,acknowledging the identified compliance <br /> issues. <br /> CORRECTIVE ACTION Ensure all designated operator inspection reports are completed and signed within the <br /> required time frame in the future. <br /> ................................................................ <br /> OBSERVATION:The designated operator failed to check and note the correct test dates for the Spill Container <br /> testing,Overfill Prevention and Secondary Containment testing on the designated operator inspection reports dated <br /> 6121/2021 to 3/7/2022 The correct dates are: <br /> -Spill Container Testing-5126+2021 <br /> -Overfill Prevention-5/252021 (87,diesel.91-1), 11124/2021 (91-2) <br /> -Secondary Containment Testing-6/712021 <br /> REGULATION GUIDANCE-During the inspection,the designated operator shall check that all required testing and <br /> maintenance for the UST system have been completed and document the dates they were done. <br /> CORRECTIVE ACTION Ensure that designated operators performing inspections at this facility are including all of <br /> the required information on the reports. <br /> This is a repeat violation,Class II. <br /> Item #208: How will these be addressed going forward? Providing signed copies will not correct the violation <br /> because they were not signed within the required timeframe. It also does not address the incorrect test <br /> dates. <br /> Response 1: DO reports: <br /> • will be signed and dated by the operator within 72 hours of receiving a signed copy of the DO report. <br /> • operator will note all corrective actions taken or that will be taken as acknowledgment of identified <br /> compliance issues. <br /> • DO reports shall be scanned to consultant for review to ensure full compliance. <br /> Response 2: Notification will be given to the Designated Operator and DO's employer of: <br /> • deficiencies to be corrected on subsequent reports. <br /> • corrections to be made to DO reports dated 6/21/2021 through 3/7/2022 indicating the proper dates <br /> for Spill Container Testing (5/26/2021); Overfill Prevention (5/25/2021 —87, diesel, 91-1) (11/24/2021 <br /> —91-2); and Secondary Containment Testing (6/7/2021). These corrections will be initialed by the <br /> current DO. When received, copies will be placed in binder for review. <br /> • corrected DO reports shall be scanned to consultant for review to ensure full compliance and replaced <br /> in DO binder onsite. <br /> 2 <br />
