On 8/12/2021 the San Joaquin County <br />Environmental Health Department (EHD) was able to inspect a part of the above-referenced property, <br />confirming the presence of the following hazardous containers: <br />On eastern side of property: <br />3 x 300-gallon totes of 3D Traser 3DT231 (Phosphoric and Sulfuric Acid) <br />On eastern side of property: <br />3 x 55-gallon poly drums of 3K-2000 Emulsion Adhesive <br />2 x 55-gallon steel drums of SealTite Pro One Zero Spray Polyurethane Foam (SPF) Component B <br />2 x 55-gallon red steel drums of an unknown substance <br />The California Health and Safety Code (HSC) §25505 requires that facilities prepare a Hazardous <br />Materials Business Plan (HMBP) if they handle reportable quantities of hazardous materials at any given <br />time in the year. Reportable quantities are 500 pounds for a solid, 55 gallons for a liquid, and 200 cubic <br />feet for gas. All chemical quantities observed at your facility exceed the reportable quantities, which trigger <br />the HMPB requirement for handling and storage. If your facility continues the storage of these chemicals, <br />and any other chemicals not observed by EHD, an HMBP permit must be obtained with the EHD. <br />If these chemicals, and any other chemicals not observed by EHD, are no longer in use and are hazardous <br />wastes, they must be handled and disposed of according to all applicable rules and regulations. Please <br />be advised, the California Code of Regulations (CCR), Title 22 § 66260.10 defines a hazardous waste <br />"generator" as any person, by site, whose act or process produces hazardous waste or whose act first <br />causes a hazardous waste to become subject to the hazardous waste regulations. Facilities that generate <br />hazardous wastes are subject to all hazardous waste regulations and permitting requirements with the <br />EHD. <br />Please be advised that the disposal of any hazardous waste, or the causing thereof, is prohibited when <br />the disposal is at a facility that is not permitted or authorized for hazardous waste disposal [HSC 25189.5 <br />1868 E.
