Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: COMCNFAOT Site Location: 1442 COLONY RD <br />Activity Summary <br />Activity Date <br />12/14/2021 Per discussion with leads Elena Manzo and Haza Saeed, a notice to abate will <br />also be issued to Chevron for not notifying the EHD timely regarding the release. <br />Emailed notice to GerardoAcuna@chevron.com. <br />Per Deborah (Debbie) Rowe of Chevron, the release happened on 12/12/2021 at <br />8am when a Dish Network van was fueling. The Environmental Health <br />Department did not receive notification of the release until 3:43pm. Per HSC <br />25510, the handler or an employee, authorized representative, agent, or designee <br />of a handler, shall, upon discovery, immediately report any release or threatened <br />release of a hazardous material, or an actual release of a hazardous substance, <br />as defined in Section 374.8 of the Penal Code, to the Unified Program Agency <br />(UPA), and to the Office of Emergency Services (OES), in accordance with the <br />regulations adopted pursuant to this section. <br />12/15/2021 I received an email from Gerardo Acuna with corrective action statements <br />addressing the notice to abate issued to Chevron regarding their late notification. <br />Gerardo also provided emergency response procedures and training records. Per <br />Gerardo, they have contacted Clean Harbors to pick-up the 30 gallon waste drum <br />and will provide disposal records once the drum has been picked-up. <br />12/20/2021 Received an email from Kevin McGee <kevin.mcgee@dish.com> with the <br />following statement: "An investigation has been conducted by the management <br />team at our Manteca office using a storm drain map provided by the City of Ripon <br />engineering department. The spill location and surrounding areas were inspected. <br />There was no evidence of a spill or any environmental impact observed by my <br />team". Kevin also provided a map of the Ripon storm drain map. <br />12/28/2021 I received an email from Gerardo Acuna on 12/23/2021 with a copy of the <br />hazardous waste manifest 016967776FLE. I printed the complaint history record, <br />Log2, 5104, and 5105 reports. Organized all complaint correspondence and <br />abated the complaint.
