1 4 . 2 The remedial actions set forth in this Order are necessary <br /> 2 to avert the danger or threat caused by releases or threatened <br /> 3 releases of hazardous substances from the Site . <br /> V <br /> 4 <br /> ORDER <br /> 5 <br /> 6 IT IS HEREBY ORDERED that the Respondent conduct the following <br /> 7 activities: <br /> 8 5 . 1 INTERIM REMEDIAL MEASURE REMEDIAL ACTION PLAN/CLOSURE PLAN <br /> 9 5. 1. 1 The existing surface impoundment (stormwater retention <br /> 10 Pond) shall be closed by June 30, 1988 under an Interim Remedial <br /> 11 Measure Remedial Action Plan/Closure Plan (IRM RAP/CP) . <br /> 12 Measures to be included in the IRM RAP/CP are listed in Exhibit <br /> 13 D. Item (1) of Exhibit D specifies the Respondent shall cease <br /> all discharges to the surface impoundment by March 15, 1988. <br /> 14 <br /> 5. 1.2 Final closure of the surface impoundment shall be in <br /> 15 <br /> 16 accordance with an approved Resource Conservation and Recovery <br /> 17 Act (RCRA) closure plan. Required revisions pertaining to the <br /> Closure Plan which was submitted September 1986 are attached as <br /> 18 <br /> 19 Exhibit E. The Respondent shall incorporate these comments into <br /> a revised closure plan and submit it to the Department by March <br /> 20 <br /> 21 <br /> 15, 1988 for approval. <br /> 5.1. 3 Implementation of the closure plan shall be performed <br /> 22 <br /> 23 subsequent to the completion of pond corrective measures <br /> 24 specified in the Remedial Action Plan. <br /> 25 5.2 ENDANGERMENT ASSESSMENT <br /> 26 <br /> 5.2. 1 Endangerment Assessment Report <br /> 27 By July 1, 1988 Respondent shall submit to the Department for <br /> _g_ <br /> COURT PAPER <br /> RTATt OF CALIFORNIA <br /> sTD. 113 IR[V. •-731 <br />
