OBSERVATION: The facility has a hazardous waste filter press tank but does not have three years of complete daily tank inspection records. REGULATION GUIDANCE: (a)The owner or operator shall inspect,where present, at least once each operating day: (1)overfill/spill control equipment(e.g.,waste-feed cutoff systems, bypass systems, and drainage systems)to ensure that it is in good working order; (2)the aboveground portions of the tank system, if any, to detect corrosion or releases of waste; (3)data gathered from monitoring equipment and leak-detection equipment, (e.g., pressure and temperature gauges, monitoring wells)to ensure that the tank system is being operated according to its design; (4)the construction materials and the area immediately surrounding the externally accessible portion of the tank system including secondary containment structures(e.g., dikes)to detect erosion or signs of releases of hazardous waste (e.g.,wet spots, dead vegetation); and (5)for uncovered tanks,the level of waste in the tank, to ensure compliance with section 66265.194(b)(3). (c)The owner or operator shall document in the operating record of the facility an inspection of those items in subsection (a)of this section. CORRECTIVE ACTION: Immediately start conducting and documenting complete daily hazardous waste tank inspections. Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department(EHD)within 30 days. This is a Class II violation. 601 CCR 66262.34(a)Stored hazardous waste on site longer than 90 days without a permit or authorization. OBSERVATION: Two 5-gallon containers of used oil were observed without hazardous waste labeling. REGULATION GUIDANCE: (a)a generator may accumulate hazardous waste on-site for 90 days or less (b)The beginning of the 90 day period is determined as follows: (1)if the generator does not generate more than 100 kilograms of hazardous waste or one kilogram of acutely hazardous waste(listed in section 66261.33(e))or one kilogram of extremely hazardous waste during any calendar month, the 90 day period begins on the date the generator has accumulated 100 kilograms of hazardous waste or one kilogram of acutely hazardous waste or one kilogram of extremely hazardous waste; (2)if the generator generates more than 100 kilograms of hazardous waste or one kilogram of acutely hazardous waste or one kilogram of extremely hazardous waste during any calendar month,the 90-day period begins on the first date on which any amount of hazardous waste begins to accumulate during that month. CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 90 days in compliance with Title 22 California Code of Regulations. Provide a corrective action statement and a copy of the disposal records to the San Joaquin County Environmental Health Department(EHD)within 30 days. This is a Class II violation.
