SPX CORPORATION ORDER R5-2019-0018 <br /> SPX MARLEY COOLING TECHNOLOGIES GROUNDWATER CLEANUP NPDES NO. CA0081787 <br /> I. FACILITY INFORMATION <br /> Information describing the SPX Marley Cooling Technologies Groundwater Cleanup Site (Facility) <br /> is summarized in Table 1 and in sections I and II of the Fact Sheet (Attachment F). Section I of the <br /> Fact Sheet also includes information regarding the Facility's permit application. <br /> II. FINDINGS <br /> The California Regional Water Quality Control Board, Central Valley Region (hereinafter Central <br /> Valley Water Board), finds: <br /> A. Legal Authorities. This Order serves as waste discharge requirements (WDR's) pursuant to <br /> article 4, chapter 4, division 7 of the California Water Code (commencing with section 13260). <br /> This Order is also issued pursuant to section 402 of the federal Clean Water Act (CWA) and <br /> implementing regulations adopted by the U.S. EPA and chapter 5.5, division 7 of the Water <br /> Code (commencing with section 13370). It shall serve as a National Pollutant Discharge <br /> Elimination System (NPDES) permit authorizing the Discharger to discharge into waters of the <br /> United States at the discharge location described in Table 2 subject to the WDR's in this <br /> Order. <br /> B. Background and Rationale for Requirements. The Central Valley Water Board developed <br /> the requirements in this Order based on information submitted as part of the application, <br /> through monitoring and reporting programs, and other available information. The Fact Sheet <br /> (Attachment F), which contains background information and rationale for the requirements in <br /> this Order, is hereby incorporated into and constitutes Findings for this Order. Attachments A <br /> through E and G through H are also incorporated into this Order. <br /> C_ Provisions and Requirements Implementing State Law. The provisions/requirements in <br /> subsections IV.B, IV.C, and V.B are included to implement state law only. These <br /> provisions/requirements are not required or authorized under the federal CWA; consequently, <br /> violations of these provisions/requirements are not subject to the enforcement remedies that <br /> are available for NPDES violations. <br /> D. Monitoring and Reporting. 40 C.F.R. section 122.48 requires that all NPDES permits <br /> specify requirements for recording and reporting monitoring results. Water Code sections <br /> 13267 and 13383 authorize the Central Valley Water Board to require technical and <br /> monitoring reports. The Monitoring and Reporting Program establishes monitoring and <br /> reporting requirements to implement federal and State requirements. The Monitoring and <br /> Reporting Program is provided in Attachment E. <br /> The technical and monitoring reports in this Order are required in accordance with Water <br /> Code section 13267, which states the following in subsection (b)(1), 'In conducting an <br /> investigation specified in subdivision (a), the regional board may require that any person who <br /> has discharged, discharges, or is suspected of having discharged discharging, or who <br /> proposes to discharge waste within its region, or any citizen or domiciliary, or political agency <br /> or entity of this state who has discharged, discharges, or is suspected of having discharged or <br /> discharging, or who proposes to discharge, waste outside of its region could affect the quality <br /> of waters within its region shall furnish, under penalty of perjury, technical or monitoring <br /> program reports which the regional board requires. The burden, including costs, of these <br /> reports shall bear a reasonable relationship to the need for the report and the benefits to be <br /> obtained from the reports. In requiring those reports, the regional board shall provide the <br /> person with a written explanation with regard to the need for the reports, and shall identify the <br /> evidence that supports requiring that person to provide the reports." <br /> WASTE DISCHARGE REQUIREMENTS 3 <br />
