Per Pruven <br /> Parsad, Line Haul Manager,the driver was washing his truck with a hose connected to a spigot on the fuel island <br /> between dispenser#2 and#3.The following facility's procedure for containing spills on the Emergency Contingency <br /> Plan section D was not implemented: <br /> #12 Notify and evacuate persons in all threatened and/or impacted areas" <br /> #15 Remove containers and/or isolate areas <br /> REGULATION GUIDANCE: <br /> Title 22 California Code of Regulations section 66265.51 Purpose and Implementation of Contingency Plan <br /> Title 22 California Code of Regulations section 66265.52 Content of Contingency Plan <br /> Title 22 California Code of Regulations section 66265.56 Emergency Procedures <br /> CORRECTIVE ACTION: Immediately prepare a contingency plan, maintain on-site and train employees on the plan <br /> contents. Provide a corrective action statement and supporting documentation to the San Joaquin County <br /> Environmental Health Department(EHD)within 30 days. <br /> This is a Class II violation. <br /> 118 CCR 66265.16 Failed to maintain complete hazardous waste training records. <br /> OBSERVATION: The business operator could not produce documentation during the inspection that demonstrates <br /> employees have complete hazardous waste training as specified in this section. Training records were requested <br /> and none could be provided.When questioned, Pruven Prasad,Angela Luna, and Khaophone Kornkhamsee of <br /> FedEx all stated they are new hired and that previous management was overhauled and training documentations <br /> are not kept on site.Training is required within 180 days of hire and annual refreshers are to follow. <br /> REGULATION GUIDANCE: <br /> New employees shall be trained within 180 days of hire and annually thereafter as specified in Title 22 California <br /> Code of Regulations section 66265.16.The owner or operator shall maintain training records on current personnel <br /> until closure of the facility and training records on former employees for at least three years from the date the <br /> employee last worked at the facility. <br /> CORRECTIVE ACTION: Immediately train all employees who work with hazardous waste in compliance with the <br /> time frames and training materials required by this section. Provide training documentation to the San Joaquin <br /> County Environmental Health Department(EHD)within 30 days.
