CONDITIONS OF APPROVAL MS-93-80 Manuel Machado, Jr. Unless otherwise specified, all Conditions of Approval and Ordinance Requirements shall be complied with prior to the approval of the Parcel Map. This approval will expire three years from the date of approval unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's Office. Those Conditions followed by a Section Number or other Statutory Requirement are based on Ordinance requirements. Ordinance requirements cannot be modified. 1. COMMUNITY DEVELOPMENT DEPARTMENT: a. All parcels shall have a minimum width of 330 feet. (Development Title Section 9-610.2) b. Parcels 1 and 2 shall be 10-acres in size. (Development Title Section 9-610.3[a][3]) C. The following note shall be placed on the Parcel Map and also recorded as a separate instrument: In accordance with Section 9-610.3 of the San Joaquin County Development Title for the creation of homesite parcels, these parcels cannot be further subdivided. 2. DEPARTMENT OF PUBLIC WORKS: See the attached memo from Public Works dated September 28, 1993. 3. PUBLIC HEALTH SERVICES: See the attached memo from Public Health dated September 21, 1993. 4. COUNTY COUNSEL a. Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code.
