Ll STIPULATED AGREEMENT SNYDER DUMP FACILITY No. 39 -CR -0031 AGREEMENT No. 2008-01 Facility Name: Snyder Dump Facility Address: 23701 S. Santa Fe Road Escalon, CA n Virginia Beard and the Environmental Health Department, the Local Enforcement Agency (LEA) for San Joaquin County, agree to and shall comply with the terms outlined in this Stipulated Agreement. ISSUE WHEREAS, the Snyder Dump, a solid waste site, is located at 23701 S. Santa Fe Road, Escalon, California (APN 249-060-12); and WHEREAS, the regulatory status of the site is considered "closed" site in accordance with Title 27, California Code of Regulations (T27 CCR) Section 21099(a) (2). The site ceased operation prior to November 18, 1990, in accordance with any regulations in effect at the time of the last receipt of waste; WHEREAS, pursuant to Title 27 CCR Section 21100(d) "Closed sites for which closure plans were not approved pursuant to Section 21099 which pose a threat to public health and safety or environment shall implement the provisions of these regulations as required by the LEA"; WHEREAS, this disposal site poses a threat to human health, safety and the environment from chemical and physical hazards from exposed solid/hazardous wastes in violation of Title 27 California Code of Regulations, Section 20700(a) — Intermediate Cover, and Section 20650 — Grading of Fill Surfaces; WHEREAS, ongoing violations in the operation of this site have been documented since November 8, 2001, December 10, 2002, July 14, 2003, May 18, 2004, September 28, 2005, October 20, 2006, and December 6, 2007 which include: 1. Title 27 CCR Section 20650 Grading of Fill Surfaces. Improper grading of fill surfaces, 2. Title 27 CCR Section 20820 Drainage/Erosion Control. Improper drainage/erosion control. 3. Title 27 CCR Section 20530- Site Security. The portion of the fence is still open and unsecured.
