Ll <br />STIPULATED AGREEMENT <br />SNYDER DUMP <br />FACILITY No. 39 -CR -0031 <br />AGREEMENT No. 2008-01 <br />Facility Name: Snyder Dump <br />Facility Address: 23701 S. Santa Fe Road <br />Escalon, CA <br />n <br />Virginia Beard and the Environmental Health Department, the Local Enforcement Agency (LEA) for San <br />Joaquin County, agree to and shall comply with the terms outlined in this Stipulated Agreement. <br />ISSUE <br />WHEREAS, the Snyder Dump, a solid waste site, is located at 23701 S. Santa Fe Road, Escalon, <br />California (APN 249-060-12); and <br />WHEREAS, the regulatory status of the site is considered "closed" site in accordance with Title 27, <br />California Code of Regulations (T27 CCR) Section 21099(a) (2). The site ceased operation prior to <br />November 18, 1990, in accordance with any regulations in effect at the time of the last receipt of waste; <br />WHEREAS, pursuant to Title 27 CCR Section 21100(d) "Closed sites for which closure plans were not <br />approved pursuant to Section 21099 which pose a threat to public health and safety or environment shall <br />implement the provisions of these regulations as required by the LEA"; <br />WHEREAS, this disposal site poses a threat to human health, safety and the environment from chemical <br />and physical hazards from exposed solid/hazardous wastes in violation of Title 27 California Code of <br />Regulations, Section 20700(a) — Intermediate Cover, and Section 20650 — Grading of Fill Surfaces; <br />WHEREAS, ongoing violations in the operation of this site have been documented since November 8, <br />2001, December 10, 2002, July 14, 2003, May 18, 2004, September 28, 2005, October 20, 2006, and <br />December 6, 2007 which include: <br />1. Title 27 CCR Section 20650 Grading of Fill Surfaces. Improper grading of fill surfaces, <br />2. Title 27 CCR Section 20820 Drainage/Erosion Control. Improper drainage/erosion control. <br />3. Title 27 CCR Section 20530- Site Security. The portion of the fence is still open and unsecured. <br />
