The San Joaquin County Environmental Health Department has the authority pursuant to Public <br />Resources Code, Sections 45000, 45005 and 45011 to order the property owner to cease and desist <br />any improper action, and to take corrective action to correct the aforementioned violations following <br />a time schedule established by San Joaquin County Environmental Health Department for the site to <br />be brought into compliance. <br />SPECIFIED ACTIONS: <br />1. Repair/Secure fence to prevent unauthorized access to the site and to prevent the illegal <br />disposal of solid waste on the property in question. <br />2. Submit to this office, for review and approval, a corrective action plan detailing how the <br />site will be brought into compliance. <br />3. The contents of the corrective action plan shall include, but not be limited to: <br />a site health and safety plan, work -plan, the schedule for site work and a site drainage <br />and erosion control plan. <br />4. All site work must be done in accordance with the approved corrective action plan. <br />COMPLIANCE SCHEDULE: <br />Item No. 1: Repair and maintain the existing fence to prohibit trespassing and illegal disposal of <br />refuse. Place "No Trespassing" signs at least every 500 feet of fence line. Install/Repair <br />perimeter fence within 30 days of issuance of this agreement. <br />Item No. 2: Within one ninety (90) days of issuance of this agreement submit the corrective <br />action pian. The LEA will either approve or deny the corrective action plan within thirty <br />(30) days of submittal. <br />Item No. 3: Site remediation shall commence within thirty (30) days of plan approval. Complete the <br />site work in accordance with the approved corrective action plan within two hundred <br />and forty (240) days of issuance of this agreement. <br />In the event the time frames for completion of the above specified activities cannot be adhered to due to <br />adverse weather or other factors not in the control of the owner, the LEA may extend the time frames <br />based upon those specific factors provided by the owner in writing. <br />AGREEMENTS AND REMEDIES: <br />The undersigned hereby agree to the following: <br />1. This agreement shall become effective immediately upon execution by the owner and the LEA. <br />No enforcement action shall be pursued against the owner if the Specified Actions and <br />Compliance Schedules contained in this Agreement are completed in accordance with the stated <br />deadlines for compliance. <br />
