The missing receipts include: <br /> -200 gallon waste oil and mixed oil 02/09/2021 <br /> -50 gallon 10/12/2021 <br /> -250 gallon waste oil and mixed oil 10/12/2021 <br /> -45 gallon 02/09/2021 <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Locate a copy of the receipts listed above. Maintain the records on-site for three years <br /> from the date of shipping and provide a copy to the San Joaquin County Environmental Health Department(EHD). <br /> If the receipts cannot be found, provide a statement to the EHD that future receipts will be maintained on-site for <br /> three years. <br /> This is a Class II violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: Stains observed in front of the used oil tank. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean the stain. Manage the waste according to Title 22 California Code of <br /> Regulations for hazardous waste. Submit a statement and supporting documentation to the San Joaquin County <br /> Environmental Health Department describing the storage and final disposition of the cleaned up waste. <br /> This is a Class II violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION: The following open hazardous waste storage containers were observed on-site: <br /> -One 55 gallon blue metal drum of used anti-freeze observed inside the shop with the funnel over the open drum. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed <br /> when not adding or removing waste.
