Known discharges or failures. 2. Malfunctioning <br /> components. 3.Any recently developed precautionary measures.The last documented annual briefing was on <br /> 1-10-2019, Mr. Henry Rotor indicated that no annual briefings were held in the recent years.According to the <br /> onsite SPCC plan, page 27, "annually, the designated person trains all employees who dispense fuel,transfer <br /> fuel/oil products and oversee the filling of fuel tanks". <br /> REGULATION GUIDANCE: (f)(3)Schedule and conduct discharge prevention briefings for your oil-handling <br /> personnel at least once a year to assure adequate understanding of the SPCC Plan for that facility. Such briefings <br /> must highlight and describe known discharges as described in§ 112.1(b)or failures, malfunctioning components, <br /> and any recently developed precautionary measures. <br /> CORRECTIVE ACTION: Discharge prevention briefings for all oil handling personnel must be scheduled and <br /> conducted at least once a year to assure adequate understanding of the SPCC Plan for that facility. Conduct all <br /> required spill prevention briefings. Provide a training log for all oil dispensing and oil handling personnel to the <br /> EHD. <br /> This is a minor violation. <br /> 705 CFR 112.8(c)(1)Container not compatible with oil stored and/or storage conditions. <br /> OBSERVATION: Failed to use containers with material and construction compatible with material stored and <br /> conditions of storage such as pressure and temperature. One diesel storage tank(estimated to be able to store <br /> 8000 gallons)was found on site,this tank doesn't appear to have adequate emergency venting.This tank was <br /> observed on a metal trailer/hitch with tires braced by tire blocks to prevent it from moving. Mr. Henry Rotor <br /> indicated that this tank is used for overflow fuel deliveries and has been brought to the site sometime in the last 1-2 <br /> years. <br /> REGULATION GUIDANCE: (c)(1)Not use a container for the storage of oil unless its material and construction are <br /> compatible with the material stored and conditions of storage such as pressure and temperature. <br /> CORRECTIVE ACTION: Immediately determine if this container is approved and has appropriate construction for <br /> diesel storage. Store oil in containers with material and construction compatible with the material stored and <br /> conditions of storage such as pressure and temperature. Ensure that all onsite tanks are properly constructed and <br /> are third-party listed for use as Aboveground Storage of Combustible or Flammable Liquids.
