It was noted that during the <br />expected subsurface clean-up project of the Lane property, additional subsurface clean-up <br />may be identified as necessary on Cal State Mortgage's property. <br />The number one consensus from our October 6, 1998 meeting was that the legal. <br />boundaries of the property owned by Cal State Mortgage would be determined. This would <br />enable your clients to do a complete clean-up of the above ground solid waste located on <br />their property. This would also help identify if recent subsurface disposal of waste has <br />occurred on Cal State Mortgage's property. Neither your clients nor the Environmental <br />Health Department staff were aware of the property boundary between Cal State Mortgage <br />and the late Mr. Lane. It was unclear if the fence lines corresponded with the actual property <br />boundaries or if recent dumping along the Santa Fe Railroad embankment had occurred on <br />your clients' property. Following the meeting, your clients were going to determine the legal <br />property boundaries of their property and provide this information to the County. <br />You indicated during our telephone conversation on October 29, 1998, that a survey <br />of the subject property had occurred. I requested that you provide this information <br />confirming the legal boundaries of your clients' property to the County. Your letter dated <br />October 29, 1998, does not provide such information. Only your personal observations as <br />a witness is forwarded to support your contentions concerning your clients' property <br />boundaries. It is requested that you submit to the Environmental Health Division a <br />description of the legal property boundaries. <br />Your letter erroneously represents that the County has not fulfilled its promises made <br />at the meeting which occurred on October 6, 1998 (your letter misstates that the meeting <br />occurred on October 5, 1998). During the meeting you specifically indicated that you would <br />notify the County of the specific documents requested, at a later time. In order to obtain <br />documents concerning this matter, please make a public records request specifying the <br />documents requested with the Environmental Health Division. The County's current charges <br />for copying public records are 10 cents per page for the first 21 pages and 7 cents per page <br />thereafter. <br />As I indicated during our telephone conversation of October 29, 1998, consistent with <br />previous County policy, the County will not purchase this property from Cal State Mortgage. <br />In addition, it is not possible for a "clean bill of health" letter to be issued by the County <br />concerning this property. <br />If your clients wish to schedule a site visit by the County of the property prior to, <br />during or following their intended surface clean-up, please notify my office for coordination. <br />
