Prior to Improvement Plan approval, the project proponents shall submit plans to the <br /> Community Development Department for review and approval which indicate (via notation on <br /> the improvement plans) that if historic and/or cultural resources, or human remains are <br /> encountered during site grading or other site work, all such work shall be halted immediately <br /> within the area of discovery and the applicant/developer shall immediately notify the <br /> Community Development Department of the discovery. In such case, the project proponents <br /> shall be required, at their expense, to retain the services of a qualified archaeologist for the <br /> purpose of recording, protecting, or curating the discovery as appropriate. The archaeologist <br /> shall be required to submit to the Community Development Department for review and approval <br /> a report of the findings and method of curation or protection of the resources. Further grading <br /> or site work within the area of discovery shall not be allowed until the preceding steps have <br /> been taken. <br /> 4. The applicant shall be required to comply with the Mitigation Monitoring Plan ideRtified as <br /> Attonhmcnt"C"included in the Conditions of Approval. <br /> 2. DEPARTMENT OF PUBLIC WORKS (Contact: [209] 468-3000) <br /> a. The applicant shall submit an application for a Site Improvement Plan for the excavation and <br /> reclamation plans for approval. <br /> b. The applicant shall pay a fair share percentage for the State Route 132/Bird Road interchange. <br /> c. All mined product haul route traffic shall be restricted to Bird Road from the existing plant to the <br /> future State Route 132 interchange. <br /> d. All raw products shall be transported to the plant via conveyers or on private haul roads. No raw <br /> products shall be transported via public roads. <br /> e. The State Route 132/Bird Road interchange shall be completed and open to traffic prior to any <br /> material leaving the properties under this permit. Work that is preliminary to mining such as <br /> landscaping will be permitted to proceed prior to the interchange being complete and open to traffic. <br /> f. An encroachment permit shall be required for work within the road right-of-way. This includes work <br /> on, over, and/or under the right-of-way (Development Title Sections 9-1145.4 and 9-1145.5). <br /> g. Implement Final EIR mitigation measure 4.1-2(a). Prior to increasing washwater discharges at the <br /> Vernalis central facility beyond what is currently allowed in the current Waste Discharge <br /> Requirements (WDRs) for that facility, the applicant shall amend the existing WDRs issued by the <br /> Central Valley Regional Water Quality Control Board (CVRWQCB) for the Vernalis central facility <br /> to accommodate the proposed increase in washwater discharge associated with the proposed <br /> project. <br /> h. Implement Final EIR mitigation measure 4.1-2(b). Prior to discharging thickened washwater to the <br /> Phase A mining area, the applicant shall apply for and obtain WDRs from the CVRWQCB for the <br /> discharge of thickened washwater to the Phase A mining area. <br /> i. Implement Final EIR mitigation measure 4.2-2. Unconfined compressive strength tests shall be <br /> conducted every 25 vertical feet, or as deemed necessary by a geotechnical consulting firm, on <br /> block samples obtained for each major slope face during the excavation of the mining areas to <br /> confirm the strength values used in the geotechnical analysis. In addition, as the quarry is <br /> excavated, a geotechnical consulting firm shall inspect the slopes every 25 vertical feet, or as <br /> deemed by the geotechnical consultant, to evaluate if the observed soils are consistent with the <br /> PA-0500847—Conditions of Approval and Monitoring and Mitigation Reporting Plan 5 <br />
