w IFF <br /> PROPERTY OWNERS'WA'1ER LICENSE AGREEMENT' <br /> ']'his Agreement is entered into on the date set forth at the end by and between Nino,LLC(collectively referred <br /> to as the"Owners"),and relates to the property identified as Assessor's Parcel Numbers 105-100-14,23 as they existed in <br /> February,2022 and depicted in a Lot Line Adjustment application submitted to San Joaquin County Community Development <br /> (PA-2200014)(collectively referred to as Property),located at 17151 E.Milton Road, Linden,CA 95236. <br /> The parcels noted refer to their designation in PA-2200014. <br /> 1. Recitals: <br /> a. The two parcels related abutt each other; <br /> b. The common water supply for Parcel 2 relates to a well(the "Well")located oil parcel 1. <br /> C. The water supply for Parcel 2 is provided via pipeline constructed from the Well. <br /> 2. Grant and Cmrfirnmtior of Lieeuse Rights. <br /> a. License. The Owner agree and grants to each Pareel and appurtenant to and for the benefit of the <br /> two abutting parcels, license rights in the Well and the related water pipeline for ingress and egress rights over Parcel I for the <br /> sole purpose of providing water,maintaining,and improving the Well and pipeline for each of the parcels, <br /> b. Nonexclusive License. The license granted to each orthe Properties is nonexclusive. 'file <br /> Owners retain the right to male any use of their property that docs not interfere unreasonably with the other <br /> Owner's use and enjoyment of the license. <br /> C. 'Termination of License. The Owners agree that upon the sale of dither parcel related to Parool 1, <br /> the license granted herein will terminate,and the Owners agree that Parcel 2 will be required to have all approved independent <br /> domestic water supply well as it condition of escrow. <br /> d. Rindhrk Effect. This Agrocment shall be binding oil and shall inure to the benefit of heirs, <br /> executors,administrators,successors,and assigns of each or the Owners. <br /> e. PSttire Aj!,rgrnenit Amendment. '['his Agreement constitutes tine entire agreement between <br /> the Owners and supersedes all prior discussions,negotiations,and agreements whether oral or written. Any <br /> annoudnncul to this agreement, including an oral modification supported by new consideration,must be reduced <br /> to writing and signed by both parties before it will be effective. <br /> f. Unenforceable Provisions. If all or part of any one or more of the provisions contained in This <br /> agreement is for any reason held to be invalid, illcgal,or unenforceable in any respect, [lie,invalidity, illegality,or uncnforcoabilit, <br /> shall not affect any other provisions,incl this agrcenncut shall be equitably construed as if it did not contain the invalid, illegal,or <br /> or unenforceable provision, <br />
