Complaint Investigation Summary Report # 5105 <br />COMPLAINT ID: COVEGSHNN Site Location: 3031 NAVY DR <br />Activity Summary <br />Activity Date Recorded by <br />01/15/2021 Received an update from Michael Anderson via email. The sump and rocks will be MURO <br />cleaned up and ready to be verified by Tuesday (Jan. 19). I asked if the storm <br />drain line will be addressed. Michael said they will be rinsed out. <br />01/15/2021 Prepared email for other inspector who will be verifying the storm drain cleanup on MURO <br />Jan 19 with map and photos. <br />01/19/2021 Went to site and met with Michael Anderson to verify clean-up of rocks, storm BAKER <br />drain and sump. Clean-up took place on on 1/18/21. Clean-up of rocks, storm <br />drain and sump appear to be complete. No odor was observed at site. No visible <br />evidence of a spill observed. Both storm drains were dry with no liquid. <br />Approximately 150 gallons of liquid was pumped out of sump initially. After clean <br />up of the lines an additional 150 gallons of liquid was pumped out of the sump. <br />Both storm drain lines to the sump were rinsed out. Rocks were cleaned off with <br />water. Waste generated has been removed from site as off-spec material. <br />Returned to office. Completed photo log and updated Claudia Muro (REHS) on <br />clean-up. <br />01/19/2021 Called Lydia Baker (EHD) to brief her on the complaint. MURO <br />Received update on the cleanup of the storm drain line and sump from Lydia. <br />01/20/2021 Contacted Michael Anderson (Yara) for follow-up on farmer information. Michael MURO <br />reported that he will be meeting with operations this afternoon and will ask for the <br />information. <br />01/25/2021 Emailed Jon Brower (SJC Ag Comissioner's Office) at jbrower@sjgov.org MURO <br />regarding the facility's sale of off-spec fertilizer product to a farmer. Asked if the <br />practice is accepted. <br />01/25/2021 Updated Elena Manzo on current complaint status. MURO <br />01/26/2021 Received an email response from Jon Brower (jbrower@sjgov.org) on <br />01-26-2021. Jon's response was that it (the practice by Yara paying a farmer to <br />take rinsate as off-spec product) seems like normal farming practice. Ag <br />Commissioner's office does not have any regulatory authority over pesticides <br />unless they are registered with the EPA, which we isn't this case. He further <br />added, if the farmer is willing to take it, it seems beneficial that the fertilizer is used <br />rather than treated as waste. <br />MURO <br />01/27/2021 Updated Elena Manzo on Jon Brower's response to farmer's use of the off-spec MURO <br />fertilizer water mixture. Emailed her a pdf of the email thread. <br />02/03/2021 Updated Elena Manzo on current complaint status. MURO <br />02/08/2021 Emailed Michael Anderson requesting status update. Michael replied and stated: MURO <br />The test came back from the soil samples. They will be disposing the soil as <br />non-hazardous waste.
