Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: COWAWQJLO Site Location: 1295 W COLONY RD <br />Activity Summary <br />Activity Date <br />05/18/2021 <br />Recorded by <br />On 5/14/21 received an email from Mike Poole (Engineering Tech 2) at BAKER <br />mpoole@cityofripon.org that there was an illegal dumping into one of the catch <br />basins, on 5/13/21 at approximately 12:30pnn. <br />Approximately 2 to 3 gallons of white acrylic paint was poured into storm system. <br />A form, site map and photographs of the incident were included. Printed <br />documents and gave to Elianna Florido (Sr. REHS) for the complaint file. <br />05/19/2021 Reviewed an email and attachments regarding the complaint, received by Lydia <br />Baker, Sr REHS, on 5/14/21 from Michael Poole, City of Ripon Engineering Tech. <br />Per Michael, 2-4 gallons of acrylic paint was illegal dumped into the storm drain by <br />a white van with license plate #5KN5142 belonging to the the business Scotty's <br />Paint (business address: 29209 Orange Ave Escalon, CA 95320). Looked up <br />business on the internet and found a Scotty's Painting at the above address. <br />Called and spoke to Michael Poole who stated Brian Head is the owner of Scotty's <br />Painting (209-613-9496). Michael stated EHD should bill Scotty's Painting for this <br />complaint. Notified Michael that EHD will need to know how much waste was <br />generated from the spill clean-up, where it was taken, the hazardous waste <br />determination, and will need a copy of the waste disposal records. Michael agreed. <br />FLORIDO <br />05/19/2021 Generated Prop 65 FLORID() <br />05/20/2021 Called Brian Head, Scotty's Painting owner (209-613-9496) and left him a voice FLORIDO <br />message requesting he call me back to discuss the complaint and to confirm his <br />email address. <br />Amended complaint OIR and emailed to Brian Head (brianhead@live.com). <br />Emailed Michael Poole reminding him to provide the requested information <br />regarding the waste generated. <br />05/20/2021 Reviewed and revised narrative. Received and reviewed photo log of the clean up FLORIDO <br />provided by John Alaniz, Sr REHS. <br />05/20/2021 Completed photo log and ER record from 5/14/2021 visit. ALANIZ <br />05/21/2021 Reviewed an Atlas Environmental Solutions certification of decontamination FLORIDO <br />regarding the spill clean-up, and a non-hazardous waste disposal record for 5,850 <br />gallons of water generated from the spill clean-up, received on 5/20/2020 from <br />James Pease, Ripon Public Works Director. Forwarded the email and paperwork <br />to Elena Manzo, Ld Sr REHS, for her review for possible abatement of the <br />complaint. <br />06/04/2021 Reviewed, printed, and organized complaint documentation. Requested John FLORIDO <br />Alaniz, Sr REHS, provide me the Emergency Response Record form. <br />06/04/2021 Reviewed narrative. Emailed James Pease and Michael Poole, requesting they FLORIDO <br />provide the waste disposal record with the designated facility signature to confirm <br />that the waste was received by the designated facility. <br />07/01/2021 Completed an ER record and forwarded it to the lead insepctor. ALANIZ <br />02/08/2022 Emailed James Pease of City of Ripon requesting he submit the non-hazardous FLORIDO <br />waste manifest with the designated facility signature. <br />5105.rpt <br /> Page 2 of 3
