Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: COWLXUNSH Site Location: JUDAH WAY & HOPKINS RD <br />Activity Summary <br />Activity Date Recorded by <br />11/08/2021 Prepared for complaint inspection. Arrived on-site and met with Caleb Smith, City FLORIDO <br />of Tracy Environmental Compliance Technician (stormwater), and Shawn Potter, <br />City of Tracy Code Enforcement Officer. A 2 ft by 3 ft stain was observed near the <br />south-east corner of the gravel and soil lot. The lot is located on the south-east <br />side of the Judah Way and Hopkins Rd intersection. Two 1 ft by 1ft lighter colored <br />stains were observed near the previously mentioned stain. Fedex vehicles were <br />not observed on-site at the time of inspection. Took photos. Discussed complaint <br />with Caleb and Shawn. Caleb stated he did not have concerns as a spill did not <br />appear to impact the storm water system. Shawn stated he would have to notify <br />Prologis of the complaint, since the staining is on Prologis's property. Left site for <br />EHD. <br />Called and spoke Chesley Underwood, Fedex Ground - Tracy facility Line Hall <br />manager, who stated she oversees the semi-truck operation. She stated that <br />FedEx does not perform vehicle fluid maintenance on the semi-truck, nor the <br />delivery trucks, since FedEx contracts contractors that own the vehicles, thus the <br />contractors perform maintenance on their own "FedEx" vehicles. I informed <br />Chesley that I would be emailing a Notice To Abate to the FedEx environmental <br />contact, Debra Gehm. Chesly provided her email so that I could CC her <br />(1573866@fedex.com) <br />Generated Notice To Abate. Emailed Notice to Abate and photos received by <br />complainant and taken today at time of inspection to Debra Gehm, Environmental <br />Compliance Specialist for FedEx Ground - Tracy - facility, and CC'd Chesly. <br />11/08/2021 Generated Compliant. SAETERN <br />11/09/2021 Updated Elena Manzo, Ld Sr REHS. Spoke with Shawn Potter, Tracy Code <br />Enforcement Officer, who confirmed there isn't much he can do, other than <br />contact the property owner, but he wasn't planning on doing that since the <br />apparent spill didn't impact their storm water system. He said if there were any <br />emails his admin staff sent to the property owner, he would CC me on them. <br />Updated Elena Manzo, Ld Sr REHS, and Melissa Nissim, CUPA Program <br />Coordinator. <br />11/09/2021 Emailed Notice To Abate to Elena Manzo, Ld Sr REHS, to mail to the property <br />owner, Prologis LP. Generated Prop 65, Emergency Response Record, photo log. <br />Added spill location coordinates to Envision Connect. Received an email from <br />Debra Gehm, FedEx environmental compliance specialist stating FedEx will hire a <br />clean-up company to perform the cleanup. Emailed Debra requesting she let me <br />know who is going to conduct the clean up and when the clean up will be done so <br />that I may go to the site to verify the clean up prior to backfill. <br />FLORIDO <br />FLORIDO <br />11/10/2021 Received a call from Alex of Ancon Services (209-414-9385) who stated he was FLORIDO <br />on-site to conduct the spill clean-up. Alex stated he observed eight small areas of <br />the soil where Fedex truck's may have leaked. Alex sent me photos of the areas. <br />Alex to let me know when he almost done with the clean-up so that I may go to the <br />site to verify prior to backfill. <br />Received a call from Debra Gehm, FedEx Environmental Compliance Specialist <br />(412-216-3701), who stated the clean-up will not be done today, since FedEx <br />needs permission from the property owner to conduct the clean-up. Debra to notify <br />me 48 hours in advance of the clean-up. Notified Debra that if the clean-up is to be <br />completed on after 5pm, on the weekend, or a holiday, to call EHD's main number <br />to be dispatched to the county hospital, and an on-call inspector will call her back. <br />Called back Alex who verified he would not be conducting the clean-up today. <br />51 05 rpt <br />Page 2 of 5
