NOTICE OF ABATEMENT ORDER Stockton Park Village, LLC - Howard Fairbanks -Anne Fairbanks Page 2 IMMEDIATELY ABATE the imminent hazards that are public nuisances and all outstanding and uncorrected violations of the Mobilehome Parks Act (MPA) as identified herein and below: I. Imminent Hazard and Public Nuisance to be abated within twenty-four (24) hours from the date of this order: 1. Repair, replace or install new Park drain lines. You are ordered to abate the public nuisance of restricted and/or clogged Park sewer drain or septic system lines by repairing, replacing or installing new Park drain lines, to stop raw sewage and human waste from backing up throughout the Park causing human waste and effluent to pond on the lot ground in violation of Health and Safety Code section 18554 subdivision (a) and (b) and CCR T25 sections 1102 and 1248. 2. Remove all sewage discharged into or onto ground within the Park caused by restricted or clogged sewer drain lines and/or septic system. You are ordered to abate the public nuisance of raw sewage and human waste from the ground and all lots inside of the Park, including but not limited to Lot#6 (sewage on lot); Lot #19 (sewage ponding behind the unit); Lot # 29 (sewage on lot), as human waste contains pathogens which can cause illness and disease and constitutes a public nuisance when improperly disposed of on the ground surface, and as such are required to do all of the following: A. Stop all sewage leaks from all recreational vehicles (RV)s, holding tanks and/or drainage piping systems onto or into the ground. B. Remove all visible sewage and contaminated soil and treat the ground with chemicals approved by San Joaquin County Environmental Health Department. Soil contaminated by sewage shall be disposed of in a manner consistent with the requirements of San Joaquin County Environmental Health Department. 3. Submit proof of compliance with this Abatement Order. You are required to submit the proof of compliance with this Abatement Order and produce proof of the following: 1) repair or replacement of the Park sewer drain or septic system lines causing the clog; 2) stop all leakage of raw sewage from drain systems or RV's located and removal of all visible sewage RV's located on lots; and 3) removal of all contaminated soil, to the Department no later than May 28, 2021. The Department will verify the proof of compliance on May 28, 2021.
