d���ElIT�,L ¢1EALT11 MAR 0 8 1994 <br /> dd PUBLIC HEALTH SEHrLt_ ' <br /> PK 2' 33 ADMINISTRATION ' <br /> BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SARI JOAQUIN <br /> STATE OF CALIFORNIA <br /> R E S O L U T I O N <br /> R-94- <br /> RESOLUTION ORDERING HEATHER MOOR ESTATES ANNEXATION TO <br /> COUNTY SERVICE AREA NO. 46, MORADA NORTH (LAFC 12-93) <br /> WHEREAS, the owners of the hereinafter described territory <br /> have filed a petition with the Local Agency Formation Commission <br /> (LAFCo) of San Joaquin County proposing annexation of their <br /> property to County Service Area No. 46, Morada North, for the <br /> purpose of obtaining domestic water and storm water drainage <br /> services; and, <br /> WHEREAS, said LAFCo conducted a duly noticed public hearing <br /> on said proposal on August 20, 1993 , and determined that the <br /> proposed annexation should be approved; and, <br /> WHEREAS, as a result of said public hearing, LAFCo did adopt <br /> Resolution No. 886 approving the proposal, designating the Board <br /> of Supervisors of San Joaquin County as the conducting authority <br /> and authorizing that Board to complete the annexation proceedings <br /> without notice and hearing pursuant to Section 57002 (c) of the <br /> Government Code. <br /> NOW, THEREFORE, BE IT RESOLVED that this Board of <br /> Supervisors, as the governing body of CSA No. 46, does hereby <br /> order the territory known as Heather Moor Estates, shown on the <br /> map and as described in Exhibit "A" attached hereto and made a <br /> part hereof, annexed to County Service Area No. 46, Morada North, <br /> pursuant to the provisions of the Cortese-Knox Local Government <br /> Reorganization Act of 1985, commencing with Section 56000 of the <br /> California Government Code. <br /> BE IT FURTHER RESOLVED that extended domestic water and <br /> storm water drainage services be provided within the territory <br /> annexed, and that such extended services shall be paid for by <br /> annual service charges collected pursuant to the provisions <br /> of Article 7 (commencing with Section 25210 . 70 thereof) of <br /> Chapter 2 . 2 of Part 2 of Division 2 of Title 3 of the Government <br /> Code of the State of California. The service area shall not <br /> assume responsibility for the extended services until the <br /> aforementioned service charges are collected. The regular <br /> County assessment will be utilized. <br />
