Submit to the Environmental Health Department, for review and approval, a corrective action plan detailing how the site will be brought into compliance. 2. The contents of the corrective action plan shall include, but not be limited to: a site health and safety plan, work -plan, the schedule for site work and a site drainage and erosion control plan. 3. All site work must be done in accordance with the approved corrective action plan. Item No. 1: Within ninety (90) days of issuance of this Notice and Order submit the corrective action plan. The LEA will either approve or deny the corrective action plan within thirty (30) days of submittal. Item No. 2: Site remediation shall commence within thirty (30) days of plan approval. The site work must be completed in accordance with the approved corrective action plan within one hundred and eighty (180) days of approval. In the event the time frames for completion of the above specified activities cannot be adhered to due to adverse weather or other factors not in the control of the owner, the LEA may extend the time frames based upon those specific factors provided by the owner in writing. PLEASE TAKE FURTHER NOTICE THAT PURSUANT TO PRC SECTIONS 45011, 45014, AND 45023. If the above actions are not completed or complied with by the specified dates, the LEA may seek administrative civil penalties in an amount not to exceed five thousand dollars ($5,000) for each day the violation occurs, or petition the superior court for injunctive relief to enforce this order and seek civil penalties not to exceed ten thousand dollars ($10,000) per day for each violation, against any person who intentionally or negligently violates any provision of applicable solid waste statute or regulation. Failure to remedy the aforementioned violation(s) by the required date(s) may result in San Joaquin County and/or the California Integrated Waste Management Board (CIWMB) expending available funds to perform any cleanup, abatement, or remedial work needed to protect public health and safety or the environment pursuant to PRC Section 48020. If the CIWMB expends funds to perform any cleanup, abatement, or remedial work, the CIWMB may seek repayment from responsible parties pursuant to PRC 48020 et seq. Moreover, any funds so expended by the CIWMB constitute a lien upon the real property owned by any responsible party that is subject to the remedial action (PRC Section 48023.5).
