Regulatory <br />Authority: <br />The San Joaquin County Environmental Heath Department k as the Local Enforcement <br />Agency (LEA) for the California Department of Resources Recycling and Recovery <br />(CalRecycle), is authorized by Division 30 Public Resources Code (PRC) Sections 43209, and <br />Title 14 of the California Code of Regulations (14 CCR) Sections 18051 and 18084, to <br />implement the solid waste regulatory program in San Joaquin County. Pursuant to PRC <br />Sections 45000, 45005, and 45011, the LEA is further authorized to order solid waste facility <br />owners or operators who are in violation of the aforementioned statutes and regulations, to <br />cease and desist any improper action, and correct the violations according to a time schedule <br />established by the enforcement agency in order to abate a nuisance or to protect the public <br />health and safety or the environment. Furthermore, pursuant to PRC 45011 and 14 CCR <br />18304.1, the LEA may impose administrative penalties for violation of any Order issued. The <br />Snyder Dump is located at 22865 South Henry Road, Escalon, APN 249-060-10. The regulatory <br />status of the site is considered 'closed" in accordance with Title 27, California Code of <br />Regulations (T27 CCR) Section 21099(x) (2). The site ceased operation prior to November 18, <br />1990, in accordance with any regulations in effect at the time of the last receipt of waste. <br />Pursuant to Title 27 CCR Section 21100(d) "Closed sites for which closure plans were not <br />approved pursuant to Section 21099 which pose a threat to public health and safety or <br />environment shall implement the provisions of these regulations as required by the LEA". The <br />site is in violation of the November 10, 2008 Notice and Order. <br />Background: <br />This disposal site poses a threat to human health, safety and the environment from chemical <br />and physical hazards, and from exposed solid and hazardous wastes. Violations were initially <br />identified on November 20, 2003 and the property owner was notified. The same violations were <br />again identified and documented at this site on May 18, 2004, September 28, 2005, October 31, <br />2006, December 6, 2007, December 12, 2008, December 9, 2009, December 30, 2010, <br />September 15, 2011, and December 8, 2011 which include: <br />1. Title 27 CCR Section 20650 Grading of Fill Surfaces. Improper grading of fill surfaces, <br />2. Title 27 CCR Section 20820 Drainage/Erosion Control. Improper drainage/erosion <br />control. <br />3. Title 27 CCR Section 20750 Site Maintenance. Abandoned autos and other solid waste <br />on the property. <br />A Notice and Order (Order) was issued to the owner/operator of the site on November 10, 2008, <br />that established a compliance schedule with a deadline of May 9, 2009. The LEA determined <br />that the site did not comply with requirements of the Notice and Order on December 9, 20091 <br />
