Penalties Imposed: <br />Pursuant to Public Resources Code (PRC) Section 45011, owner/operator of the facility is <br />subject to an administrative penalty of up to $ 5,000 per day for each day that each violation <br />exists. EHD is imposing administrative penalty on property owner/operator of the <br />aforementioned parcel, in the amount of $ 190.575.00 consisting of a per day penalty of $ 50 for <br />1,155 days plus 10% for aggravating circumstances for each violation. Payment is due within 30 <br />days from the effective date of this Penalty Order and is payable by check, cashier's check, <br />credit card, or money order. The check shall be made payable to: San Joaquin County, <br />Environmental Health Department. Payment shall be mailed or delivered to 1868 E. Hazelton <br />Ave, Stockton, CA 95205. The administrative penalties assessed pursuant to this Penalty Order <br />are in addition to and do not supersede or limit any other applicable remedies, including civil, <br />provided by State Law or County Code. Furthermore, if cited violations are ongoing or if new <br />violations are documented after the date of this Penalty Order, additional administrative <br />penalties may be assessed for each day that a violation exists. <br />Righfi to a Hearing: <br />The owner/operator of the facility may, within 15 days after service of this Penalty Order, <br />request in writing a hearing pursuant to PRC 44307 providing the reason(s) why you should not <br />be subject to the imposed penalties. <br />Meeting Offered: <br />If you would like to schedule a meeting to discuss this Penalty Order you may contact Robert <br />McClellon at (209) 468-0332. <br />
